BY-LAW NO. 2010-055
A BY-LAW TO AUTHORIZE THE EXECUTION
OF A CONTRACT BETWEEN THE MUNICPALITY OF BAYHAM
AND
HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO
AS REPRESENTED BY THE MINISTER OF NATURAL RESOURCES
(THE "MINISTER")
UNDER SECTION 23 OF O.REG 242/08 MADE UNDER
THE ENDANGERED SPECIES ACT,2007
WHEREAS Section 23 of O. Reg 242/08 made under The Endangered Species Act, 2007,
permits municipalities that have municipal drains to enter into an exemption agreement for
purposes of constructing, improving,maintaining or repairing Drainage Works with The
Minister of Natural Resources;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of
entering into an Endangered Species Act exemption agreement with the Minister of Natural
Resources for such municipal drainage works;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized and directed to execute the
contract attached hereto as Schedule "A" and forming part of this by-law between the
Municipality of Bayham and The Minister of Natural Resources (the "Minister"
regarding Section 23 of O. Reg 242/08 made under The Endangered Species Act, 2007.
2. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 3RD DAY
OF JUNE 2010.
