HomeMy WebLinkAboutBy-law No. 2010-009 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2010-009 BEING A BY-LAW TO FURTHER AMEND BY-LAW #1780 AS AMENDED BY BY-LAW#1828 BEING A BY-LAW TO PROVIDE FOR THE STRAFFORDVILLE MUNICIPAL DRAIN WHEREAS the Corporation of the Township of Bayham By-law#1780 enacted on the 30th day of April, 1973 as amended by the Corporation of the Township of Bayham By-law #1828 enacted the 1day of July, 1974 provided for the construction of the Straffordville Municipal Drain; and for the levy assessments upon lands and roads to which the Straffordville Municipal Drainage works is chargeable; AND WHEREAS a portion of lands falling within the watershed of the Straffordville Municipal Drain have been severed and as such it is necessary to reapportion the drainage assessment affecting those lands affected; AND WHEREAS "Agreements between Property Owners for Drainage Apportionment due to Land Severance/ Sale"as prepared by the Bayham Drainage Superintendent have been accepted and duly executed by the current property owners of those retained and severed lands; AND WHEREAS the Council of the Corporation of the Municipality of Bayham now deems it necessary to reapportion the assessments contained within the assessment schedules attached to By-law#1780; NOW THEREFORE THE CORPORATION OF THE MUNICIPALITY OF BAYHAM HEREBY ENACTS AS FOLLOWS: 1. THAT the assessment contained in Graham, Berman&Associates Engineer's Report dated June 14, 1972 affecting property identified as Roll Number 34-01-000-004- 02500 for lands located within part of Lot 125, Concession 6,with a watershed valued at$1,522.00 shall be reapportioned as follows: Severed Property: Assessment Roll #34-01-000-004-02400 Legal Description: Part 1 on Reference Plan 11R-5968 and Part 2 on Reference Plan 11R-9153 Part Lot 125, Concession 6 (severed lot combined with original parcel) Drainage Apportionment: Assessed at$675.21 Severed Property: Assessment Roll#34-01-000-004-02505 Legal Description: Part 1 on Reference Plan 11R-7889 Part Lot 125, Concession 6 Drainage Apportionment: Assessed at$376.61 Bayham By-law#2010-009 Severed Property: Assessment Roll#34-01-000-004-02510 Legal Description: Part 2 on Reference Plan 11R-7889 Part Lot 125, Concession 6 Drainage Apportionment: Assessed at$382.39 Remaining Property: Assessment Roll#34-01-000-004-02500 Legal Description: Part 1 on Reference Plan 11R-9153 Part Lot 125, Concession 6 Drainage Apportionment: Assessed at$254.68 2. THAT the apportioned costs of any future maintenance work authorized by the Council of the Municipality of Bayham and carried out under the supervision of the Drainage Superintendent on the Straffordville Municipal Drain shall reflect the reapportionment in Paragraph#1 herein. 3. THAT the reapportionment of drainage assessments as set out in Paragraph#1 herein will cease when Council accepts a new Engineer's Report assessing this portion of the Straffordville Municipal Drain. 4. Effective Date: This By-law comes into full force and effect on the passing thereof. Read a first and second time this 18th day of February,2010.
