HomeMy WebLinkAboutBy-law No. 2008-098 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2008-098 BEING A BY-LAW TO STOP UP, CLOSE AND CONVEY THAT PART OF THE UNOPENED ROAD ALLOWANCE KNOWN AS FIRST ALLEY WHEREAS Section 11 of the Municipal Act,2001, S.O. 2001,c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Highways, including parking and traffic on highways; AND WHEREAS Section 8 of the said Municipal Act provides that a municipality has the capacity,rights,powers,and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS notice of intent to pass this By-law has been published once in the Aylmer Express, a newspaper of general circulation to the area; AND WHEREAS the Council of the Corporation of the Municipality of Bayham has heard in person, or by counsel, solicitor or agent, all persons claiming that their land will be prejudicially affected by this By-law and who applied to be heard; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it expedient to stop up,close and convey those parts of First Alley as set out in Schedule"A" attached hereto and forming part of this By-law to the adjoining land owners, specifically, Part 1 on Plan 11R-8998 to Donald Gordon Sykes. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT upon and after the passing of this By-law those portions of the unopened road allowance described in Schedule"A"attached hereto and forming part of this By-law be and are hereby closed and stopped up. 2. THAT all of that part of the said unopened road allowance described in Schedule "A"attached hereto and forming part of this By-law and stopped up shall be conveyed to the adjoining owner of Plan 54 Lot 25 EIS Centre Street,being Donald Gordon Sykes. 3. THAT the Mayor and Clerk of The Corporation of the Municipality of Bayham be and they are hereby authorized and directed to execute such deeds or other documents as may be necessary to effect conveyances of those parts of the said road allowance described herein and which have been stopped up and closed. 4. THAT this by-law shall come into full force and effect upon the date of its enactment. 5. THAT this by-law shall be registered in the Land Registry Office for the Registry Division of Elgin, (No. 11). READ A FIRST TIME this 16th day of October,2008.
