BY-LAW NO. 2008-056
A BY-LAW TO AUTHORIZE THE EXECUTION
OF A CROSS BORDER AGREEMENT
BETWEEN THE MUNICIPALITY OF BAYHAM
AND THE CORPORATION OF NORFOLK COUNTY
TO PROVIDE FOR THE
MAINTENANCE AND CLEANOUT OF BOUNDARY DRAINS
WHEREAS under Section 5 of the Municipal Act, 2001, S.O. 2001, Chapter 25, as amended,
states that the powers of the Municipal Council shall be exercised by By-Law, unless the
municipality is specifically authorized to do otherwise;
AND WHEREAS under Section 9 of the Municipal Act, 2001, S.O. 2001, Chapter 25, as
amended, states that the municipality has the capacity, rights,powers and privileges of a natural
person for the purposes of exercising its authority;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it
expedient to enter into a cross border agreement with the Corporation of Norfolk County for the
maintenance and cleanout of boundary drains;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT Council does confirm and ratify the cross border agreement hereto annexed and
marked as Schedule"A"to this By-law;
2. THAT the Mayor and Clerk of the Corporation of the Municipality of Bayham are
hereby authorized and directed to execute an agreement hereto annexed and marked as
Schedule"A"to this By-Law and all other documentation necessary to complete this
transaction;
3. THAT this By-Law come into full force and affect upon final passing.
READ A FIRST, SECOND AND THIRD TIME and finally passed this 5th day of June
2008.
