BY-LAW 2008 -018
A BY-LAW TO AUTHORIZE THE EXECUTION
OF A MUTUAL DRAIN AGREEMENT WITH
JOHAN AND KATHARINA PENNER
WHEREAS Section 2 of The Drainage Act, RSO, 1990, Chapter D.17, provides that when two
or more owners of land desire to construct or improve a drainage works on any of their lands and
are willing to pay the cost thereof, they may enter into a written agreement for the construction,
improvement, financing and maintenance of such drainage works;
AND WHEREAS the Municipality desires to recognize an existing drainage flow path across
Part Lot 32 east of Centre Street,Registered Plan 54 owned by Johan and Katharina Penner;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham now deems
it necessary to approve a Mutual Drain Agreement to recognize an existing drainage flow path
across land specifically described as Parts 2 and 3 of Registered Plan 11R-8767, P.I.N.
#35332-0142, Part Lot 32, Registered Plan 54,Village of Vienna, Municipality of Bayham,
County of Elgin;
NOW THEREFORE THE CORPORATION OF THE MUNICIPALITY OF BAYHAM
HEREBY ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized and directed to execute the
agreement with Johan and Katharina Penner affixed hereto and forming part of this
By-law and marked as Schedule"A", being a Mutual Drain Agreement.
2. THAT the executed agreement shall be registered under the proper Land Titles
Registry.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 7TH
DAY OF FEBRUARY 2008.
