BY-LAW NO.2008-012
A BY-LAW TO ASSIGN THE AGREEMENT WITH UNDERHILL FARMS LIMITED
FOR THE PROVISION OF CONTRACT WINTER CONTROL SERVICES
FOR THE MUNICIPALITY OF BAYHAM TO
UNDERHILL BROS.2131876 ONTARIO LIMITED
WHEREAS the Council of the Corporation of the Municipality of Bayham did on November
17, 2005 enter into an agreement with Underhill Farms Limited for the provision of contracted
winter control services;
AND WHEREAS the Municipality of Bayham did by By-laws 2006-105 and 2007-097 renew
the agreement for further one year terms;
AND WHEREAS the Municipality of Bayham and Underhill Farms Limited are desirous of
assigning the renewal agreement for contracted winter control services to be performed under the
jurisdiction of the Municipality to Underhill Bros. 2131876 Ontario Limited;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT The Corporation of the Municipality of Bayham hereby assigns the Agreement
with Underhill Farms Limited for the provision of contracted winter control services to
Underhill Bros. 2131876 Ontario Limited;
2. THAT all other terms and conditions of the agreement attached to By-law 2005-117, as
amended by By-law 2006-105 and By-law 2007-097, are hereby confirmed.
3. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 17TH
DAY OF JANUARY 2008.
