BY-LAW NO. 2007-099
A BY-LAW TO AUTHORIZE THE EXECUTION OF A
WATER SERVICES DEVELOPMENT AGREEMENT
WITH LOUIS AND DOROTHY TOTH
WHEREAS Section 11 of the Municipal Act, 2001, R.S.O. 2001, c. 25 as amended provides that a
lower tier municipality may pass by-laws respecting public utilities,including water distribution;
AND WHEREAS the Municipality of Bayham has by By-law No. 98-21, By-law No. 95-42, and
By-law No. 91-4, established rules and regulations for the operation and maintenance of a system of
waterworks in the Municipality including the connection thereto;
AND WHEREAS the said owners, Louis and Dorothy Toth, have made application for consent to
create one Village Residential building lot(County of Elgin Land Division Committee Application
E36/07);
AND WHEREAS the County of Elgin Land Division Committee has granted the subject
application, subject to conditions including the condition that the owner execute a development
agreement for the provision of municipal water to the proposed lot;
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to approve an
Agreement to permit such connection by by-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized and directed to execute the
Agreement with Louis and Dorothy Toth affixed hereto and forming part of this By-law and
marked as Schedule"A",being an agreement to connect to the Municipal water system with
a private connection within the Municipal highway known as Lakeshore Line.
2. THAT the executed agreement shall be registered under the Land Titles Act for the Registry
Division of Elgin(No. 11).
READ A FIRST,SECOND AND THIRD TIME AND FINALLY PASSED THIS DAY OF
NOVEMBER 2007.
