HomeMy WebLinkAboutBy-law No. 2007-068 Bayham By-law#2007-068 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW #2007-068 AMENDING BY-LAW #2073 BEING A BY-LAW TO PROVIDE FOR THE RAMSEY MUNICIPAL DRAIN WHEREAS the Corporation of the Township of Bayham By-law#2073 enacted on the 18th day of June 1981 provided for the construction of the Ramsey Municipal Drain; and for the levy assessments upon lands and roads to which the Ramsey Municipal Drainage works is chargeable; AND WHEREAS a portion of lands falling within the watershed of the Ramsey Municipal Drain have been severed and as such it is necessary to reapportion the drainage assessment affecting those lands affected; AND WHEREAS "Agreements between Property Owners for Drainage Apportionment due to Land Severance/ Sale" as prepared by the Bayham Drainage Superintendent have been accepted and duly executed by the current property owners of those retained and severed lands; AND WHEREAS the Council of the Corporation of the Municipality of Bayham now deems it necessary to reapportion the assessments contained within the assessment schedules attached to By-law#2073; NOW THEREFORE THE CORPORATION OF THE MUNICIPALITY OF BAYHAM HEREBY ENACTS AS FOLLOWS: 1. THAT the assessment contained in Spriet Associates Engineer's Report dated March 27, 1981 affecting property identified as Roll Number 34-01-000-006-13300 for lands located within Lot 25, in Concession 9, with a watershed of 0.6 hectares, valued at $270.00 shall be reapportioned as follows: Severed Property: Assessment Roll #34-01-000-006-13302 Legal Description: Part 1 on Reference Plan#11R-3333 North Part Lot 25, Concession 9, %of Original Apportionment to be applied to Severed Property is 95 % Drainage Apportionment: 0.57 hectares Assessed at$256.50 Remaining Property: Assessment Roll#34-01-000-006-13300 Legal Description: North Part Lot 25, Concession 9, % of Original Apportionment to be applied to Retained Property is 5 % Drainage Apportionment: 0.06 hectares Assessed at$13.50 2. THAT the assessment contained in Spriet Associates Engineer's Report dated March 27, 1981 affecting property identified as Roll Number 34-01-000-006-13900 for lands located within Lot 25, in Concession 9, with a watershed of 6.7 hectares, valued at $4,220.00 shall be reapportioned as follows: Severed Property: Assessment Roll#34-01-000-006-13905 Legal Description: Part 1 on Reference Plan#11R-8504 North Part Lot 26, Concession 9, % of Original Apportionment to be applied to Severed Property is 95 % Drainage Apportionment: 6.365 hectares Assessed at$4,009.00 1 Bayham By-law#2007-068 Remaining Property: Assessment Roll#34-01-000-006-13300 Legal Description:North Part Lot 26, Concession 9, %of Original Apportionment to be applied to Retained Property is 5 % Drainage Apportionment: 0.335 hectares Assessed at $ 211.00 3. THAT the apportioned costs of any future maintenance work authorized by the Council of the Municipality of Bayham and carried out under the supervision of the Drainage Superintendent on the Ramsey Municipal Drain shall reflect the reapportionment in Paragraph #1 and Paragraph#2 herein. 4. THAT the reapportionment of drainage assessments as set out in Paragraph#1 and Paragraph#2 herein will cease when Council accepts a new Engineer's Report assessing this portion of the Ramsey Municipal Drain. 5. Effective Date: This By-law comes into full force and effect on the passing thereof.
