BY-LAW NO. 2007-037
A BY-LAW TO APPOINT A DRAINAGE SUPERINTENDENT
UNDER THE DRAINAGE ACT
WHEREAS Section 93(1), of the Drainage Act,R.S.O. 1990, c. D.17 as amended,provides in part
that the council of a local municipality may by by-law appoint a drainage superintendent:
(a)to initiate and supervise the maintenance and repair of any drainage works;
(b)to assist in the construction or improvement of any drainage works; and
(c) to report to the council on the superintendent's activities mentioned in clauses (a) and(b)
AND WHEREAS Section 4 of the Tile Drainage Act R.S.O. 1990, c. T.8 as amended, provides
in part that the council of a local municipality borrowing money under this Act shall employ an
inspector of drainage
AND WHEREAS the Council of the Municipality of Bayham is desirous of appointing Mr.
William Knifton to the office of Drainage Superintendent to be performed on behalf of the
Municipality in accordance the said Act.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT Mr. William Knifton be and is hereby appointed the Drainage Superintendent for
the Municipality of Bayham, to perform duties pursuant to the Drainage Act, R.S.O.
1990, Chapter D.17, and Regulations thereunder, commencing April 5th, 2006, and until
such appointment is repealed.
2. THAT Mr. William Knifton be and is hereby appointed the Drainage Inspector for the
Municipality of Bayham, to perform duties pursuant to the Tile Drainage Act, R.S.O.
1990, Chapter T.8, and Regulations thereunder, commencing April 5th, 2006, and until
such appointment is repealed.
3. THAT By-law No. 2006-19, passed March 16th, 2006 be and the same is hereby
repealed.
4. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST AND SECOND TIME AND THIRD TIME AND FINALLY PASSED this
5th day of April,2007.
