HomeMy WebLinkAboutBy-law No. 2006-088 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.2006-088 A BY-LAW TO SET OUT REMUNERATION FOR APPOINTEES TO THE COURT OF REVISION UNDER PROVISIONS OF THE DRAINAGE ACT WHEREAS The Drainage Act,R.S.O. 1990 Ch 17 Section 97(1) states: Subject to subsections (3), (4) and(5), a court of revision shall consist of three or five members appointed by the council of the initiating municipality and such members other than members of the council may be paid such remuneration and expenses as the council may by by-law provide; and AND WHEREAS Section 97(3) states: Where the lands assessed for the drainage works extend from the initiating municipality into a neighbouring municipality, the court of revision shall consist of two members appointed by the council of the initiating municipality, of whom one shall be chair and one member appointed by the council of each of the neighbouring municipalities and the court shall hear and rule on appeals as if the entire area affected by the drainage works were in one municipality. AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of setting rates for remuneration of members appointed by a neighbouring municipality to a Court of Revision being held in the Municipality of Bayham; AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of setting such rates by by-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT each person appointed by a neighbouring municipality to attend a Court of Revision being held in the Municipality of Bayham be paid an attendance fee of$65.00 (sixty-five dollars)per attendance at such meeting of the Court of Revision; 2. THAT mileage reimbursement to the person appointed by the neighbouring municipality attending such Court of Revision be paid at a rate of$.45 per kilometre travelled to and from the meeting of the said Court of Revision 3. AND THAT this by-law shall take effect upon the date of its enactment. READ A FIRST, SECOND,AND THIRD TIME and fmally passed this 21.'t day of September 2006. / AYI CLERK
