HomeMy WebLinkAboutBy-law No. 2006-079 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2006-079 Being a By-law to provide for the release of a registered site plan agreement WHEREAS site plan approval for development of the lands described in Schedule"A"("the Lands") was given by By-law No. 96-16 of the Corporation of the Municipality of Bayham; AND WHEREAS the site plan agreement was registered as Instrument No. 371573 against title to the Lands on August 28, 1996; AND WHEREAS the current owner of the property, William and Rosemary Ball (the"Owner")has advised the Municipality that it no longer wishes to proceed with development in the manner proposed by the approved site plan; AND WHEREAS the owner has made a written request for the repeal of By-law No. 96-16 and the release of the said site plan agreement as evidenced by Schedule"B"to this By-law; AND WHEREAS the owner has applied for consent to sever under application E113/05 the single detached dwelling with outbuildings as a surplus farm dwelling, which does not require site plan approval; NOW THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. The site plan approval given by By-law No. 96-16 of the Corporation of the Municipality of Bayham is hereby revoked at the request of the owner. 2. The Owner is hereby released from all obligations set out in the agreement registered on title on August 28, 1996, as Instrument No. 371573. 3. Schedules"A" and"B" shall form part of this By-law. Box 160 9344 Plank Road Straffordville, Ontario NOJ 1YO Dear Sirs/Madams: Re: Site Plan Agreement Instrument No.371573 -August 28, 1996 We hereby confirm our request to the Council of the Municipality of Bayham that By-law No. 96-16 of the Corporation of the Municipality of Bayham be repealed and that we be released from the site plan agreement which was registered on title to our lands on August 28, 1996, as Instrument No. 371573. We hereby represent that our plans with respect to the lands have changed. We no longer wish to develop the land in accordance with the site plan and intend to complete a consent under application El 13/05 to sever the single detached dwelling and outbuildings as a surplus farm dwelling. We have been advised that site plan approval is not required. We agree to be responsible for all the costs incurred by the Municipality in connection with legal advice or other expenses associated with the processing and execution of this request.
