HomeMy WebLinkAboutBy-law No. 2006-075 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NUMBER 2006-075 WHEREAS the Council of the Municipality of Bayham did by By-law 2000-69 authorize the execution of an agreement between the Solicitor General of Ontario and The Elgin Group of Municipalities including the Corporation of the Municipality of Bayham ("the Municipality") for the provision of police services under section 10 of the police services act, r.s.o. 1990, c. p. 15; AND WHEREAS the parties are desirous of extending this agreement; NOW THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as follows: 1. THAT the Corporation of the Municipality of Bayham authorizes the extension of the Agreement with the Ministry of Community Safety and Correctional Services for Police Services, as outlined in Schedule"A" attached to and forming part of this By-law. 2. THAT the Mayor and the Clerk are hereby authorized to execute the amending Agreement and Affix the Corporation Seal thereto. CLif,RK This AMENDING AGREEMENT,made in four(4) originally executed copies, is made as of the 1st day of September, 2006. BETWEEN: HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO as represented by THE MINISTER OF COMMUNITY SAFETY AND CORRECTIONAL SERVICES ("Ontario") -and- THE CORPORATION OF THE MUNICIPALITY OF WEST ELGIN,THE CORPORATION OF THE MUNICIPALITY OF BAYHAM, THE CORPORATION OF THE TOWNSHIP OF SOUTHWOLD,THE CORPORATION OF THE MUNICIPALITY OF CENTRAL ELGIN, THE CORPORATION OF THE MUNICIPALITY OF DUTTON/DUNWICH,AND THE CORPORATION OF THE TOWNSHIP OF MALAHIDE. (Herein after collectively called the "Elgin Group") BACKGROUND A. The Parties entered into the Agreement for the Provision of Police Services under Section 10 of the Police Services Act(the "Agreement") on the 1St day of July 2000. B. The Agreement includes all the Schedules and Appendices to the Agreement. C. Pursuant to Section 25,the Parties may amend the Agreement by written agreement. D. The Parties wish to amend the Agreement as set out in this Amending Agreement to extend the duration of the contract signed on the 1St day of July 2000,to conclude on the 15t Day of September, 2006 as supported by Bylaw#2006-45 dated,the 10th of August 2006 of the Council of Municipality of West Elgin Bylaw# 2006-075 dated,the 17th of August 2006 of the Council of the Municipality of Bayham Bylaw#2006-41 dated,the 14th of August 2006 of the Council of the Township of Southwold Bylaw#923 dated,the 11th of December 2006 of the Council of the Municipality of Central Elgin Bylaw#2006-42 dated, the 211d of August 2006 of the Council of the Municipality of Dutton/Dunwich Bylaw# 06-48 dated, the 3rd of August the Council of the Township of Malahide NOW THEREFORE, the Parties agree as follows: The following shall be added as section 22.1 to the Agreement: 22.1 Notwithstanding the date upon which this Amending Agreement is signed, the term of this Agreement shall commence on the 1st day of July 2005, and shall conclude on the 15`Day of September, 2006. Relevant terms and conditions of the Agreement, that are not specifically amended but that relate to the amendments set out in this Amending Agreement shall be deemed to be amended so as to give effect to the changes herein. Except for the amendments set out herein,the terms and conditions of the Agreement remain in full force and effect and time shall remain of the essence. That the Corporation of the Municipality of West Elgin enter into an agreement with the Minister of Community Safety and Correctional Services in the form of agreement which is attached hereto as Schedule 2. That the Mayor and Clerk are authorized to execute such agreement and to affix the corporate seal of the Municipality of West Elgin thereto. 3. THAT the Corporation of the Municipality of Central Elgin authorizes the extension of the Agreement with the Ministry of Safety and Correctional Services for Police Services, as outlined in Schedule "A" attached to and forming part of this By-law. 2. That the Corporation of the Municipality of Dutton/Dunwich enter into an Agreement with the Ministry of Community Safety and Correctional Services for Police Services, and that the said contract shall be known as Schedule"A" attached hereto this by-law. 2. WHEREAS the Council of the Corporation of the Township of Malahide is desirous to enter into a renewal Agreement with the Minister of Community Safety and Correctional Services for the provision of Police Services. NOW THEREFORE Council assembled enacts as follows: 1. THAT the Mayor and the Clerk be authorized to sign the attached Schedule "A" being a Renewal Agreement for provision of Police Services between the Corporation of the Township of Malahide and The Minister of Community Safety and Correctional Services.
