HomeMy WebLinkAboutBy-law No. 2006-033 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2006-033 A BY-LAW TO ESTABLISH THE BAYHAM BUSINESS AND COMMERCE COMMITTEE WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Economic Development Services AND WHEREAS the Council of the Corporation of the Municipality of Bayham desires to promote, expand and enhance the economic development/tourism/culture program within the municipality, and to implement a revised Committee structure in support of these goals in accordance with the Bayham Culture Plan AND WHEREAS the Council considers it expedient to establish a committee whose responsibility shall be to develop programs and projects for such purposes. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Council of The Corporation of the Municipality of Bayham hereby establishes a committee to be known as the Bayham Business and Commerce Committee whose terms of reference are set out in Schedule "A" attached hereto and forming part of this by-law. 2. THAT the said Committee shall be considered as a Committee of Council and all members of the committee shall be appointed by Council as set out in the Terms of Reference. 3. THAT the said Committee shall operate in accordance with the said Terms of Reference which are hereby adopted. 4. THAT this By-law establishing the"Bayham Business and Commerce"Committee as set out in said Schedule"A"attached shall come into full force and effect on June 1, 2006. 5. AND THAT By-law No. 2004-83 adopted by the Council of Municipality of Bayham October 7th 2004,be and same is hereby repealed; READ A FIRST AND SECOND TIME this 20th day of April,2006. MA �� CL RK Schedule "A"to By-law 2006-033 BAYHAM BUSINESS AND COMMERCE COMMITTEE Terms of Reference ESTABLISHMENT The Bayham Business and Commerce Committee is established by the Council of the Corporation of the Municipality of Bayham by By-law No. 2006-033, enacted and passed by Council on April 20th, 2006. NAME OF COMMITTEE The Committee will be known as the "Bayham Business and Commerce Committee" MANDATE The Committee will provide advice, assistance, and support to Bayham Council in the area of business and commerce support and growth in Bayham. Included in this mandate is advice and recommendations relative to infrastructure and development of the municipal waterfront and renewal of the "Main Streets" of Bayham, including Port Burwell, Vienna, and Straffordville. The Committee will work closely with the Tourism and Community Marketing Committee and Museums Bayham. OBJECTIVES The Committee will concentrate on development of strategies, initiatives, and activities for the promotion of business and commerce in the Municipality of Bayham. Industrial development strategies, resources for all areas of commerce, and business "readiness"will be priority areas, as well as business retention and expansion initiatives. Through community involvement, this group will co-ordinate plans for the community's future by developing strategies to change and enhance the social, economic and environmental situation. They will identify and prioritize the needs of the community and encourage partnerships and a cohesive"community spirit". A focus will be placed on initiating and developing action plans which will contribute to community renewal in such areas as business, employment opportunities, and infrastructure. MEMBERSHIP/TERMS OF OFFICE Appointments will be made by the Council of the Municipality of Bayham. The Committee shall have the following membership configuration: ▪ The Mayor or designate and two additional members of Council • Three to six individuals from the community,preferably with representation from each of the three wards, representing various areas of interest throughout the community and a cross section of the business and commerce sectors of Bayham as much as possible, for example ,Service/Retail Sector #Agriculture/Farming Sector #Trucking Sector #Construction Sector 'Fisheries 0 Industrial Sector 0 Commercial Sector For the year 2006, all members will serve for a term to expire December 31, 2006 and thereafter, appointments shall be for a three year term. A Secretary will be appointed by the Committee to prepare agendas, and keep minutes of meetings. The Municipality shall appoint a staff support person as it deems necessary. Appointment of Chair/Vice Chair At the first meeting in each calendar year, the Committee will select a Chair and a Vice Chair who will assume the role of the Chair in his/her absence. B/L aDo6- 033 set,. A ' P6 1. Vacancies All voting members will remain in office until their respective successors are appointed by Council. In the event of a vacancy, either as a result of a resignation or expiration of the term of office, the Committee will recruit replacement members and recommend appointments to be made by Council. PROCEEDINGS 1. Frequency of Meetings Meetings will be held a minimum of quarterly, at such dates and times as is convenient for the members. Meetings may be held in the Bayham Municipal Office Committee Room or as otherwise directed or re-scheduled by the Chair. 2. Quorum A quorum will consist of not less than half plus one of the total number of appointed voting members. If there is no quorum within twenty minutes of the scheduled time for the meeting, the Chair will re-schedule the meeting date. Members are urged to call the Secretary and advise of any regrets. 3. Voting A majority vote of the members present will be used to reach a decision on matters before the Committee. 4. Establishment of Sub-committees It is anticipated that for various projects and initiatives that sub-committees or technical sub-groups to focus on one component of an action plan or a specific task will be formed by the Committee. These members would not be appointed by Council but would be appointed by and serve at the pleasure of the Committee. Appropriate minutes shall be maintained and circulated to the Committee. To provide additional expertise not found in its membership base, the utilization of volunteers from outside of the committee membership is encouraged. Main Street Renewal Task Force The Committee shall appoint a Main Street Renewal Task Force which shall work with the Committee for the renewal of"Main Streets" in Bayham, including in Port Burwell, Vienna, and Straffordville. Waterfront Development Task Force The Committee shall appoint a Waterfront Development Task Force, which shall work with the Committee for the development of the Bayham waterfront, its priorities, and potential marina development. 5. Reporting To Council/Budgets and Expenditures Minutes of Committee meetings will be circulated to Council. The Chairman or designate will attend Council meetings as required to provide updates on activities. Annually,the Committee shall: • Submit a proposed budget to Council for consideration for the following fiscal year • Present an action plan for the forthcoming year and report on current year activities All expenditures must be included in the approved current budget. The Municipal policy on procurement shall apply for all expenditures.
