BY-LAW NO.2006-019
A BY-LAW TO APPOINT A DRAINAGE SUPERINTENDENT UNDER
THE DRAINAGE ACT AND TO AUTHORIZE THE EXECUTION OF
AN AGREEMENT BETWEEN THE MUNICIPALITY OF BAYHAM
AND DWAYNE DANIEL FOR THE PROVISION OF TEMPORARY
DRAINAGE SUPERINTENDENT SERVICES
WHEREAS Section 93(1), of the Drainage Act, R.S.O. 1990, c. D.17 as amended,provides in part
that the council of a local municipality may by by-law appoint a drainage superintendent:
(a)to initiate and supervise the maintenance and repair of any drainage works;
(b) to assist in the construction or improvement of any drainage works; and
(c)to report to the council on the superintendent's activities mentioned in clauses (a) and (b)
AND WHEREAS the position of C.B.O./Drainage Superintendent for the Municipality of
Bayham will be vacant due to a resignation effective March 19th, 2006.
AND WHEREAS the Municipality of Bayham is desirous of entering into an Agreement for
temporary contracted services for the office of Drainage Superintendent to be performed on
behalf of the Municipality in accordance the said Act.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT Mr. Dwayne Daniel be and is hereby appointed the Drainage Superintendent for
the Municipality of Bayham, to perform duties pursuant to the Drainage Act, R.S.O.
1990, Chapter D.17, and Regulations thereunder, commencing March 20th, 2006, and
until such appointment is repealed.
2. THAT the Mayor and Clerk be and they are hereby authorized to execute the Agreement
attached hereto as Schedule "A" and forming part of this by-law, being a contract
agreement between Dwayne Daniel and the Municipality of Bayham for the provision of
temporary Drainage Superintendent services.
3. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST AND SECOND TIME AND THIRD TIME AND FINALLY PASSED this
16th day of March,2006.
