HomeMy WebLinkAboutBy-law No. 2005-108 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO.2005-108 A BY-LAW TO AMEND BY-LAW 2002-03,AS AMENDED BEING A BY-LAW TO APPOINT MUNICIPAL OFFICERS AND EMPLOYEES FOR THE MUNICIPALITY OF BAYHAM WHEREAS pursuant to the Municipal Act, 2001, S.O. 2001 c.25, as amended, municipalities may appoint officers and employees as may be necessary for the purposes of the Corporation; AND WHEREAS Subsection 6(1)of the Fire Protection and Prevention Act, 1997, S.O. 1997, C.4 provides that if a fire department is established for the whole or a part of a municipality or for more than one municipality, the council of the municipality or the councils of the municipalities, as the case may be, shall appoint a fire chief for the fire department; AND WHEREAS Ontario Regulation 380/04, a Regulation passed under authority of the Emergency Management Act, R.S.O. 1999, C. E.9, provides in part that every Municipality shall designate an employee of the municipality or a member of the council as its emergency management program co- ordinator; AND WHEREAS Subsection 3 (2) of the Building Code Act, S.O. 1992, c.23, as amended, provides that the council of each municipality shall appoint a chief building official and such inspectors as are necessary for the enforcement of the Act,in the areas in which the municipality has jurisdiction; AND WHEREAS the Council of the Municipality of Bayham did by By-law 2002-03, and by subsequent amendments thereto, appoint municipal officers and employees for the purposes of the Corporation; AND WHEREAS, the Council of the Municipality of Bayham deems it necessary and expedient to provide a new by-law to appoint municipal officers and employees for the purposes of the Municipality to reflect various staff changes made, and repeal By-law 2002-03 as amended. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the following officers and/or employees be and they are hereby appointed to act in the capacity provided in the Municipality of Bayham for the purpose of administering and where applicable enforcing municipal by-laws and Provincial Statutes and Regulations associated with each position and the approved job descriptions are to be fulfilled: Office/Position Name 1.
