HomeMy WebLinkAboutBy-law No. 2005-047 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2005-047 A BY-LAW TO AMEND BY-LAW NO. 2002-98,BEING A BY-LAW TO ADOPT A NON-UNION PERSONNEL POLICY WHEREAS the Council of the Municipality of Bayham passed By-Law No. 2002-98 to adopt a personnel policy for non-union employees December 19th,2002; AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary and expedient to amend by-law 2002-98 to implement changes to the policy to the Municipal Staff Organization; NOW THEREFORE THE CORPORATION OF THE MUNICIPALITY OF BAYHAM HEREBY ENACTS AS FOLLOWS: 1. THAT subsection 1.5 under the heading "Payday" of the said Non-Union Personnel Policy be and the same is hereby amended by deleting therefrom "Thursday and ending on the 2n1 Wednesday" and inserting "Monday and ending on the 21tSunday". 2. THAT subsection 3.1 under the heading "Seminars, Conventions, Conferences" of the said Non-Union Personnel Policy be and same is hereby amended by deleting therefrom "Two hundred and twenty-five ($225.00) per diem" and inserting "Two hundred and sixty-two ($262.00) per diem (2005 rate, to be adjusted January each year by the Annual CPI)". 3. THAT subsection 6.1 under the heading of"Hiring of Relatives" of the said Non- Union Personnel Policy be and the same is hereby deleted, and the following inserted: "6.1 Hiring of Relatives Relatives of persons currently employed by the Municipality, or relatives of a member of Council or a local board, may be hired only if they will be employed in a position that does not directly report to or supervise the relative. Employees cannot be transferred into such a reporting relationship. For the purposes of this policy, a relative is defined as a spouse, common-law spouse, same sex partner, child, common-law spouse's child, mother, father, brother, sister, grandchild, son-in-law, daughter-in-law, brother-in-law, sister-in- law, mother-in-law, father-in-law, common-law spouse's mother, common-law spouse's father, grandparent, spouses grandparents, aunt, uncle. If the relative relationship is established after employment, the individuals concerned will decide who is to be transferred. If that decision is not made within 30 calendar days,management will decide. Notwithstanding this Policy, all employees employed by the Municipality and in this situation at the time of adoption of this policy will be exempt from this requirement. All employees are required to report relationships to the Municipality that would place them in violation of this policy. If the relationship is found to have been deliberately concealed from the Municipality at the time the relative is hired or thereafter, the employment of one or both of the relatives maybe terminated." 4. THAT Schedule "A-1" of the said Non-Union Personnel Policy be and the same is hereby repealed, and replaced Schedule "A-1" (Salary Grid 2005) affixed hereto and forming part of this by-law, and such schedule shall be effective March 1, 2005. 5. THAT the Municipality of Bayham Staff Organization Chart, forming part of the Non-Union Personnel Policy, be and the same is hereby repealed, and replaced with the Organizational Chart affixed hereto and forming part of this by-law, and such schedule shall be effective March 1, 2005. 6. AND THAT this by-law shall come into full force and effect upon final passing.
