BY-LAW NO. 2005-043
A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE
CORPORATION OF THE COUNTY OF ELGIN, THE CORPORATION OF THE
MUNICIPALITY OF WEST ELGIN,THE CORPORATION OF THE MUNICIPALITY
OF DUTTON-DUNWICH,THE CORPORATION OF THE TOWNSHIP OF
SOUTHWOLD, THE CORPORATION OF THE MUNICIPALITY OF CENTRAL ELGIN,
THE CORPORATION OF THE TOWNSHIP OF MALAHIDE,THE CORPORATION OF
THE MUNICIPALITY OF BAYHAM, THE CORPORATION OF THE TOWN OF
AYLMER,AND THE CORPORATION OF THE CITY OF ST. THOMAS
FOR THE DISTRIBUTION OF FINES LEVIED IN PROVINCIAL OFFENCES COURT
WHEREAS certain administrative functions in respect of proceedings commenced pursuant to
the Provincial Offences Act were transferred fro the Province of Ontario to the County of Elgin
March 1, 2001;
AND WHEREAS the functions transferred include the right to collect unpaid fines levied in
Provincial Offences Court both before and after March 1, 2001;
AND WHEREAS the lower tier municipalities in Elgin, the City of St. Thomas, and the County
of Elgin deem it necessary and expedient to enter into and agreement for the distribution of such
fines as collected by the County of Elgin;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM HEREBY ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and they are hereby authorized and directed to execute the
Agreement attached hereto as Schedule "A" and forming part of this by-law, being an
agreement between The Corporation of the County of Elgin, The Corporation of the
Municipality of West Elgin, The Corporation of the Municipality of Dutton/Dunwich, The
Corporation of the Township of Southwold, The Corporation of the Municipality of Central
Elgin, The Corporation of the Township of Malahide, The Corporation of the Municipality of
Bayham, the Corporation of the Town of Aylmer, and the Corporation of the City of St.
Thomas for the distribution of fines levied in Provincial Offences Court.
2. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 19TH
DAY OF MAY,2005.
