BY-LAW 2005-040
BEING A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT
BETWEEN THE CORPORATION OF MUNICIPALITY OF BAYHAM AND
ELGIN COUNTY ARCHIVES
WHEREAS Section 254(3) of the Municipal Act, 2001. S.O. 2001. c.25, as
amended, provides that a municipality may enter into an agreement regarding
archival services;
AND WHEREAS Section 254(4) provides that a local, regional or university
archives can be deemed an archivist;
AND WHEREAS Section 254(5) provides that a municipality may transfer to the
archivist any record which it has a duty to retain and preserve;
AND WHEREAS it is deemed expedient that the Corporation of the Municipality
of Bayham designate the Elgin County Archives as the "archivist";
AND WHEREAS it is deemed expedient that the Corporation of the Municipality
of Bayham enter into an Agreement with Elgin County Archives for the purpose of
transferring records.
NOW THEREFORE the Council of the Corporation of the Municipality of Bayham
enacts as follows:
1. That the Corporation of the Municipality of Bayham hereby designates the
Elgin County Archives as "Archivist".
2. That the Corporation of the Municipality of Bayham enter into an
agreement with Elgin County Archives in the form of Agreement which is
attached hereto and marked as Schedule "A".
3. That the Mayor and Clerk are authorized to execute such agreement and
to affix the Corporate Seal of the Municipality of Bayham thereto.
4. That this by-law shall come into force and effect upon the final passing
thereof.
READ A FIRST AND SECOND TIME ON THE 5111 DAY OF MAY 2005.
READ A THIRD TIME AND FINALLY PASSED ON THE 5TH DAY OF MAY 2005.
