BY—LAW NO. 2005-030
A BY—LAW TO AUTHORIZE THE EXECUTION OF A
DEVELOPMENT AGREEMENT WITH RICHELLE
SPANJERS AND GARY VANLEEUWEN
WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended provides that a
lower tier municipality may pass by-laws respecting public utilities, including sanitary sewage
collection.
AND WHEREAS Richelle Spanjers and Gary Vanleeuwen are owners of lands in Part of Lot 23,
Concession 9,Registered Plan 113 in the Municipality of Bayham.
AND WHEREAS the said owners have made applications for consent to create three hamlet
residential building lots (County of Elgin Land Division Committee Applications E15/04, E16/04,
and E17/04).
AND WHEREAS the County of Elgin Land Division Committee has granted the subject
applications, subject to conditions including the condition that the owners execute a sewer services
development agreement for each lot.
AND WHEREAS prior to development occurring on the subject lands, certain services, namely
installation of sanitary sewers, and completion of satisfactory drainage plans, are required.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized and directed to execute the
Agreement with Richelle Spanjers and Gary Vanleeuwen affixed hereto and farming part of
this By-law and marked as Schedule"A".
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 21s` DAY
OF APRIL,2005.
