HomeMy WebLinkAboutBy-law No. 2005-021 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW 2005-021 BEING A BY-LAW TO ADOPT A COMMUNITY IMPROVEMENT PLAN FOR THE VILLAGE OF PORT BURWELL VILLAGE OF VIENNA VILLAGE OF STRAFFORDVILLE AND HAMLET OF EDEN IN THE MUNICIPALITY OF BAYHAM WHEREAS the Municipality of Bayham in accordance with provisions of Section 17 (22) of the Planning Act, R.S.O. 1990, on July 5, 2001,by By-law 2001-60, adopted an Official Plan for the Municipality of Bayham; AND WHEREAS on August 15, 2002 the Ministry of Municipal Affairs and Housing approved the said Official Plan for the Municipality of Bayham; AND WHEREAS Subsections 28 (2) and(7)of the Planning Act,R.S.O. 1990,Chapter 13, as amended, authorizes municipalities to adopt a Community Improvement Plan; NOW THEREFORE the Council of the Corporation of the Municipality of Bayham, in accordance with the provisions of Subsections 28 (2) and (7) of the Planning Act, R.S.O. 1990, Chapter 13, as amended hereby enacts as follows: 1. THAT the Community Improvement Plan for the Village of Port Burwell,Village of Vienna,Village of Straffordville and Hamlet of Eden,in the Municipality of Bayham, attached hereto as Schedule"A"is hereby adopted. 2. AND THAT the Community Improvement Plan attached hereto shall come into full force and effect upon approval by the Minister of Municipal Affairs and Housing. Subsection 28 (7)of the said Planning Act,provides that for the purpose of carrying out a community improvement plan that has come into effect, the municipality may make grants or loans to registered owners, assessed owners and tenants of lands and buildings within the community improvement project area, and to anyperson to whom such an owner or tenant has assigned the right to receive a grant or loan, to pay for the whole or any part of the cost of rehabilitating such lands and buildings in conformity with the community improvement plan. This Community Improvement Plan is implementation of the Official Plan for the Municipality of Bayham adopted by the Municipality July 1; 2001 and approved by the Minister of Municipal Affairs and Housing August.15,2002. The Official Plan as adopted includes a comprehensive set of community improvement policies (Section 6.0). In the said Official Plan, the Councilfor the Municipality of Bayham determined that all of the Hamlets and Villages as designated in the Official Plan shall form the community improvement areas in the Municipality. In 2004, the community Economic Development and Tourism Committee, composed of representatives from the business community,tourism community, and other members of the public, reviewed and recommended implementation of a Facade Improvement Program for commercial properties as part of the Economic Development strategy for the Municipality of Bayham. The Committee undertook a review of building and site conditions in the key business areas in each of the areas designated Village in the Official Plan, and recommended implementation of a plan to improve the physical conditions of such business areas. The Committee and Council reviewed in detail possible methods of facade improvement programs, including grant programs, forgivable loan programs, and loan programs. In consideration of the needs of the businesses in the core areas identified, and recognizing the fiscal resources of the Municipality, the Committee and Council are recommending the implementation of a loan program. Sufficient monies have been allocated in the 2004 Municipal Budget for implementation of such loan program. 1 March 2005 2.0 Selection of Project Areas The Community Improvement Project Areas are located in the Village of Port Burwell, Village of Straffordville, Village of Vienna, and Hamlet of Eden as defined in the Official Plan. The Project Areas were selected in accordance with the identification of the following criteria established in the Official Plan,which are characteristic of the areas: i) The areas are of predominately commercial land use which are potentially stable and viable; ii) A need for aesthetic improvements or beautification which may enhance the commercial viability of businesses in the area; iii) An observed decline in the commercial assessment in the area and/or a decline in the number or variety of commercial establishments in the area. 2 March 2005 3.0 Definition and Description of the Project Areas The Community Improvement Project Areas include the traditional core business areas of the Villages of Port Burwell, Vienna, and Straffordville and the Hamlet of Eden. The areas included are as shown on Schedule Al,A2,A3 and A4 to this Plan. The core business area of Port Burwell consists of approximately 25 properties located on Robinson Street and Wellington Street. The area is predominantly commercial in use and zoning, with approximately 3 vacant properties. The area is located on higher traffic roads (County Roads), and Ieads to and is in close proximity to the main tourism opportunities for the area. These opportunities include the Municipally owned beach,the Municipal Marine Museum and Lighthouse, the Port Burwell Provincial Park, and the harbour area owned by the Federal Department of Fisheries and Oceans (Small Craft Harbours). The core business area of Vienna consists of approximately 20 properties located on Plank Road (County Road No. 19). The area is predominantly commercial in use with approximately 3 vacant properties. Zoning is Commercial, Floodway or Flood Fringe, This area is located on the primary north/south traffic-route through the Municipality,and- is an area of high visibility for all industrial,commercial,and tourist.traffic. The core business area of Straffordville consists of approximately 41 properties located on Heritage Line(County Road No. 38)and Plank Road(County Road No. 19). The area is predominantly zoned for commercial or residential use, and has a mixed use of commercial and residential areas. There are approximately 4 vacant commercial properties. Again,this area is located on the primary north/south traffic route through the Municipality, and on a significant east/west traffic route, and is an area of high visibility for all industrial,commercial,and tourist traffic. The core business area of Eden consists of approximately 5 properties located on Plank Road (County Road No. 19). The area is predominantly residential, with a limited commercial component,with no currently vacant properties. The existing land uses within the Community Improvement Project Area will not be altered and none of the project entails the acquisition of property. 3 Match 2005. 4.0 Proposed Improvements The Community Improvement Projects subject of this plan Is comprised solely of a Façade Improvement Program initiated to assist in the improvement and promotion of the core business areas. The program is to provide financial incentives for improvements/beautification of facades, including signage, entrances, and windows, for commercial properties in the defined areas. The financial incentives are initially to contribute low interest loans for a ten year period on eligible properties based on 50/50 matching contributions from the owners. Details of the program, criteria, and review process are further outlined on Schedule B. The total amount of any loan cannot exceed the total rehabilitation costs in accordance with subsection 28 (7.1)of the Planning Act. 4 March 2005 5.0 Estimated Costs The costs to the Municipality are limited to the interest cost to the Municipality for outstanding loans. The Municipality will borrow from-internal Reserve and/or Trust Funds to finance loans, to the limit specified by Council and subject to the annual municipal budget approval process. Repayment will be made from loan repayments of principal and interest, and from the annual tax levy. The maximum annual limit of all loans under this Plan will be established at$50,000. The initial annual limit of all loans will be $20,000, pursuant to the current municipal budget. Interest cost on such.initial Ioans is estimated at$1,000. 5 March 2005 6.0 Implementation and Amendment It is the intention of Council to initiate the Façade Improvement LoanProgram upon approval of the Community Improvement Plan by the Province of Ontario. Successful applicants will be required to execute loan agreements with the Municipality prior to receipt of loan funds. Loans will commence upon approval of the Community Improvement Plan,however it is expected that total loans to the current limit specified by Council in Section 5.0 will not occur until year two of the program at the soonest. Amendments to the plan will be required for additions or deletions to the Project Area,or to alter the Loan Program to provide for a grant process, and such amendments will require approval by the Ministry of Municipal Affairs and Housing. Eligible improvements consist of external repairs to facades, including signage, entrances, and display windows. Interior work and roof work is not eligible. Commercial properties in the core business areas of Port Burwell, Vienna, Straffordville, and Eden will be eligible for the program. Applications may be submitted by registered owners of properties in the defined areas, or tenants of such properties. Where tenants make the application, acknowledgement and agreement of the registered owner(s) will be required. The program will contribute loans of up to $5,000 per property,based on 50/50 matching contributions. The loan will have a low interest rate of 0% in the first year and 2% each year thereafter based on a maximum 10-year loan term. Loans of less than $500 will not be considered. Payment of loans will be forwarded after completion of the approved construction. Property taxes must be up to date to be eligible. As security, the Municipality will hold a lien on the lands. The Municipality also requests that the improvement be maintained as approved and constructed for the 10 year loan period. Should the business/property be sold, all remaining loan amounts become due and payable. The repayment schedule will be set up that the greater of$500 or 10% of the loan amount is payable annually on tax due dates. Early payment of outstanding amounts will be permitted. The Economic Development Committee for the Municipality will be the loan review committee. The Committee will review plans and applications and make recommendations to Council. Grant applications will be reviewed and selected in March each year, with application due at the end of February. Funds are limited and will be allocated at Council's sole discretion. 11 P. March 2005 Appendix"I" Community Improvement Plan Village of Port Burwell,Village of Vienna,Village of Straffordviile,Hamlet of Eden in the Municipality of Bayham Commercial Building Condition Survey Appendix"r 12 March 2005 Commercial Building Condition Survey - Municipal Staff undertook a survey of building conditions for existing commercial buildings in the Community Improvement Project Area in the summer and fall of 2004. The survey is intended to determine the number of location of buildings and structures which need some form of renovation and/or rehabilitation. The following criteria was used as a basis for the evaluation: 1. Good —no structural defects or maintenance deficiencies 2. Minor — cosmetic or superficial deficiencies —painting,siding,or replacement of eavestroughs necessary,wood rot,clean up of property etc. 3. Moderate —non-structural in nature—may require weatherproofing and other improvements for energy efficiency —window frame rot, roof reshingling, settlement, drainage problems,doors and openings deficient etc. 4. Zoning is Commercial, Floodway or Flood Fringe. This area is located on the primary north/south traffic route through the Municipality,and- is an area of high visibility for all industrial,commercial,and tourist traffic. The core business area of Straffordville consists of approximately 41 properties located on Heritage Line(County Road No.38)and Plank Road(County Road No. 19). The area is predominantly zoned for commercial or residential use, and has a. mixed use of commercial and residential areas. There are approximately 4 vacant' commercial properties. Again,this area is located on the primary north/south traffic route through the Municipality, and on a significant east/west traffic route, and is an area of high visibility for all industrial,commercial,and tourist traffic. The core business area of Eden consists of approximately 5 properties located on Plank Road (County Road No. 19). The area is predominantly residential, with a limited commercial component,with no currently vacant properties. The existing land uses within the Community Improvement Project Area will not be altered and none of the project entails the acquisition of property. 3 • March 2005 4.0 Proposed Improvements The Community Improvement Projects subject of this-plan Is comprised solely of a Facade Improvement Program initiated to assist in the improvement and promotion of-the core business areas. The program is to provide financial incentives for improvements/beautification of facades, including signage, entrances, and windows, for commercial properties in the defined areas. The financial incentives are initially to contribute low interest loans for a ten year period on eligible properties based on 50150 matching contributions from the owners. Details of the program, criteria, and review process are further outlined on Schedule B. The total amount of any loan cannot exceed the total rehabilitation costs in accordance with subsection 28 (7.1)of the Planning Act. 4 March 2045 5.0 Estimated Costs The costs to the Municipality are limited to the interest cost to the Municipality'for outstanding loans. The Municipality will borrow from•internal Reserve and/or Trust Funds to finance loans, to the limit specified by Council and subject to the annual municipal budget approval process. Repayment will be made from loan repayments of principal and interest, and from the annual tax levy. The maximum annual limit of all loans under this Plan will be established at$50,000. The initial'annual limit of all loans will be $20,000, pursuant to the current municipal budget. Interest cost on such.initial loans is estimated at$1,000. • 5 March 2005 6.0 Implementation and Amendment It is the intention of Council to initiate the Façade Improvement Loan'Program upon approval of the Community Improvement Plan by the Province of Ontario. Successful applicants will be required to execute loan agreements with the Municipality prior to receipt of loan funds. Loans will commence upon approval of the Community Improvement Plan,however it is expected that total loans to the current limit specified by Council in Section 5.0 will not occur until year two of the program at the soonest. Amendments to the plan will be required for additions or deletions to the Project Area,or to alter the Loan Program to provide for a grant process, and such amendments•will require approval by the Ministry of Municipal Affairs and Housing. Eligible improvements consist of external repairs to facades, including signage, entrances, and display windows. Interior work and roof work is not eligible. Commercial properties in the core business areas of Port Burwell,Vienna, Straffordville, and Eden will be eligible for the program. Applications may be submitted by registered owners of properties in the defined areas, or tenants of such properties. Where tenants make the application, acknowledgement and agreement of the registered owner(s)will be required. The program will contribute loans of up to $5,000 per property,based on 50/50 matching contributions. The loan will have a low interest rate of 0% in the first year and 2% each year thereafter based on a maximum 10-year loan term. Loans of less than$500 will not be considered. Payment of loans will be forwarded after completion of the approved construction. Property taxes must be up to date to be eligible. As security, the Municipality will hold a lien on the lands. The Municipality also requests that the improvement be maintained as approved and constructed for the 10 year loan period. Should the business/property be sold, all remaining loan amounts become due and payable. The repayment schedule will be set up that the greater of$500 or 10%of the loan amount is payable annually on tax due dates. Early payment of outstanding amounts will be permitted. The Economic Development Committee for the Municipality will be the loan review committee. The Committee will review plans and applications and make recommendations to Council. Grant applications will be reviewed and selected in March each year, with application due at the end of February. Funds are limited and will be allocated at Council's sole discretion. 11 r •. The survey is intended to determine the number of location of buildings and strictures which need some form of renovation and/or rehabilitation: The following•criteria was used as a basis for the evaluation: • 1. Good —no structural defects or maintenance deficiencies 2. Minor — cosmetic or superficial deficiencies --painting,siding,or replacement of eavestroughs necessary,wood rot,clean up of property etc. 3. Moderate —non-structural in nature—may require weatherproofing and other improvements for energy efficiency —window frame rot, roof reshingling, settlement, -drainage problems,doors and openings deficient etc. 4.
