BEING A BY-LAW TO AMEND BY-LAW 2004-015
BEING A BY-LAW TO SET WATER AND SEWER
RATES IN THE MUNICIPALITY OF BAYHAM
WHEREAS the Municipal Act S.O. 2001, Chap. M. 25 as amended provides that the Council of
a local Municipality may by by-law provide for imposing upon owners or occupants of land who
use sewage works a sewage service rate, and;
WHEREAS the Municipal Act S.O. 2001, Chap. M. 25 as amended provides for imposing rates,
regulating, metering, measuring and collection frequencies and methods for water and sewer
rates;
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to amend by-
law 2004-015;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
THAT Section 4.04 be repealed and replaced with:
All persons who contact the water/wastewater superintendent outside regular
business hours for services on private property (beyond the curbstop) or for
services/information that could wait until the next business day shall be charged a
minimum of $250.00 for each call. Property owners who fail to winterise their
water meter and plumbing appropriately, resulting in the water meter to freeze and
burst, shall be charged a minimum $250.00 for each incident. If the
superintendent determines, in his/her discretion, that his/her services are
mandatory, this fee may be waived.
AND THAT Schedule A be repealed and replaced with the attached Schedule
A.
THIS by-law to come into effect upon its passing and includes the January-February 2005 billing
period.
