HomeMy WebLinkAboutBy-law No. 2005-014 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2005-014 A BY-LAW TO AUTHORIZE THE EXECUTION OF A LETTER OF UNDERSTANDING WITH THE TOWNSHIP OF SOUTH-WEST OXFORD FOR THE PROVISION OF MUTUAL AID FIRE ASSISTANCE WHEREAS Subsection 2 (5) of the Fire Protection and Promotion Act, 1997 provides that a municipality may, under such conditions as may be specified in the agreement, enter into an agreement to, (a) provide such fire protection services as may be specified in the agreement to lands or premises that are situated outside the territorial limits of the municipality; and (b) receive such fire protection services as may be specified in the agreement from a fire department situated outside the territorial limits of the municipality AND WHEREAS the Municipality of Bayham adopted By-law No. 2000 — 65 on August 3rd, 2000, to authorize the Bayham Fire Department to respond to calls for assistance from other municipal fire departments authorized to participate in the Elgin County Mutual Aid Plan or any other Regional, District or County Emergency Fire Service Plan and Program on a reciprocal basis. AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of entering into a letter of understanding with the Township of South-West Oxford for the provision of Mutual Aid assistance; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Letter of Understanding attached hereto as Schedule "A" and forming part of this by-law between the Township of South-West Oxford and the Municipality of Bayham for the provision of Mutual Aid Assistance. 2. BETWEEN: The Corporation of the Municipality of Bayham herein referred to as "Bayham" -and- The Corporation of the Township of South-West Oxford, herein referred to as "South-West Oxford". WHEREAS both Bayham and South-West Oxford have passed by-laws authorizing their fire department to leave the limits of their respective municipalities to respond to calls for assistance from other municipal fire departments participating in a mutual fire aid system on a reciprocal basis; Therefore it is understood and agreed as follows: 1. In the event that the Brownsville Fire Department has responded to an emergency in Bayham as authorized under the agreement for Automatic Aid service between Bayham and South-West Oxford, after the first hour of call-out the Brownsville Fire Department will, at the request of the Bayham Fire Department,provide mutual aid assistance. 2. It is agreed that the Bayham Fire Department will respond to a call for assistance on a mutual aid basis from South-West Oxford, and vice versa, South-West Oxford will respond to a call for assistance on a mutual aid basis from the Bayham Fire Department in situations not covered by Paragraph I hereof. 3. Where a fire department requests Mutual Aid assistance under this agreement, and requests the use of materials, such materials shall be replaced by the fire department making the request. The materials include, but are not limited to Class A and B Foams, extinguisher refills and spill absorbents. 4. This Letter of Understanding may be terminated by either of the Parties upon thirty (30) days written notice. That the Mayor and Clerk are hereby authorized to execute the Mutual Aid agreement attached hereto as Schedule"A"and forming part of this by-law. 2. This By-Law shall come into force and effect on the date of the final passing hereof READ a First and Second time this 15th day of February, 2005 READ a Third time and finally passed this 15th day of February, 2005.
