HomeMy WebLinkAboutBy-law No. 2004-083 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2004-083 A BY-LAW TO ESTABLISH THE BAYHAM COMMUNITY ECONOMIC DEVELOPMENT & TOURISM COMMITTEE WHEREAS Section 11 of the Municipal Act, 2001, 5.0. 2001,c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Economic Development Services AND WHEREAS the Council of The Corporation of the Municipality of Bayham desires to promote, expand and enhance the economic development and tourism within the municipality; AND WHEREAS the Council considers it expedient to establish a committee whose responsibility shall be to develop programs and projects for this purpose. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Council of The Corporation of the Municipality of Bayham hereby establishes a committee to be known as the Bayham Community Economic Development & Tourism Committee whose terms of reference are set out in Schedule"A" attached hereto and forming part of this by-law. 2. THAT the said Committee shall be considered as a Committee of Council and all members of the committee shall be appointed by Council as set out in the Terms of Reference. 3. THAT the said Committee shall operate in accordance with the said Terms of Reference which are hereby adopted. 4. THAT this By-law shall come into full force and effect on the date of its passage. 5. THAT By-law No. 99-30 adopted by the Council of Municipality of Bayham April 15th, 1999,be and same is hereby repealed. READ A FIRST AND SECOND TIME this 7th day of October,2004. READ A THIRD TIME AND FINALLY PASSED this 7th day of October,2004. 4,11, 1111,1.0f CLERK BEDTC Schedule "A"to By-law 2004-083 BAYHAM COMMUNITY ECONOMIC DEVELOPMENT &TOURISM COMMITTEE Terms of Reference ESTABLISHMENT Established by the Council of the Corporation of the Municipality of Bayham by By-law No. 2004-083 NAME OF COMMITTEE The Committee will be known as the "Bayham Community Economic Development& Tourism Committee". MANDATE "A COMMUNITY WORKING TOWARDS SOCIAL, ECONOMIC AND ENVIRONMENTAL GROWTH" OBJECTIVES Through community involvement, this group will co-ordinate and plan for our community's future by developing strategies to change and enhance the social, economic and environmental situation. They will identify and prioritize the needs of the community and encourage partnerships and a cohesive"community spirit". A focus will be placed on initiating and developing action plans which will contribute to community renewal in such areas as business, employment opportunities,beautification, recreation, tourism, natural resources and heritage. Understanding that community economic development is a plan for the long term,the main focus of this community group is to be proactive in the creation of a vibrant healthy community which responds to everyone's needs. A community with an appreciation for its diverse rural and urban lifestyles, a strong economic base, enhanced tourism and an appreciation for its natural and heritage resources. "A Growth Community." BEDTC Page 2 APPOINTMENTS/TERMS OF OFFICE The Committee will recommend appointments to be made by the Council of the Municipality of Bayham and membership will be comprised of up to ten voting members representing various areas of interest throughout the community. For example, areas of interest may include: #Churches and church groups # Volunteer sector #Education #Fisheries #Youth $Service clubs •Heritage 'Business •Tourism $Municipal Council •Business/Commerce #Industry •Agriculture/Farming •Parks/Recreation Committee members will be appointed by Council and will serve for one year terms. Committee members will remain until their successors are appointed by Council. Up to two members of Council shall be appointed as Committee members. In additions, the Mayor shall be ex-officio a member of the Committee. A Secretary will be appointed by the Administrator. Appointment of Chair 1 Vice Chair At the first meeting in each calendar year,the Committee will select a Chair and a Vice Chair who will assume the role of the Chair in his/her absence. Vacancies All voting members will remain in office until their respective successors are appointed by Council. In the event of a vacancy, either as a result of a resignation or expiration of the term of office,the Committee will be responsible for recruiting replacement members and recommending appointments to be made by Council. BEDTC Page 3 PROCEEDINGS l. Frequency of Meetings Meetings will be held monthly, or at other frequency determined appropriate by the Committee. Times and locations of meetings shall be determined by the Committee. 2. Quorum A quorum will consist of not less than half plus one of the total number of appointed voting members. If there is no quorum within twenty minutes of the scheduled time for the meeting,the Chair will re-schedule the meeting date. Members are urged to call the Secretary and advise of any regrets. 3. Voting A majority vote of members present will be used to reach a decision on matters before the Committee. 4. Establishment of Sub-committees It is anticipated that for various projects and interests that sub-committees or technical work-groups may be formed by the Committee to focus on one component of an action plan, a specific task, or areas of special interest. These members would not be appointed by Council and would be appointed by the Committee for the utilization of volunteers from outside of the committee membership to provide additional expertise not found in its membership base. 5. Reporting To Council The Committee shall: • Annually submit a proposal for budget considerations for the fiscal year • Provide minutes of all committee meetings to Council for information and approval of actions where necessary • As required,recommend the appointment of members 6. Expenditures Expenditures must be included in the approved current budget.
