HomeMy WebLinkAboutBy-law No. 2004-078 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2004-078 A BY-LAW TO AUTHORIZE THE EXECUTION OF A CONTRACT AGREEMENT BETWEEN THE MUNICIPALITY OF BAYHAM AND F.J. GALLOWAY ASSOCIATES INC. TO DEVELOP A BAYHAM CULTURAL PLAN WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25 as amended provides that a lower tier municipality may pass by-laws respecting Culture,parks,recreation, and heritage. AND WHEREAS the Municipality of Bayham has created the Bayham Culture Committee to strengthen the community's heritage resources and promote a better understanding of Bayham's heritage and culture. AND WHEREAS the Bayham Culture Committee has entered in to a Collaborative Agreement for the purpose of application to the Ontario Trillium Foundation for funding support to prepare and implement a Bayham Cultural Plan, with the Bayham Historical Society as lead applicant. AND WHEREAS the Ontario Trillium Foundation has provided funding to develop a cultural plan for the Municipality of Bayham, approved by the Ontario Trillium Foundation Board May 7th, 2004. AND WHEREAS the Bayham Culture Committee issued a Request for Proposals to undertake the preparation of a Cultural Plan, and has recommended the acceptance of the proposal submitted by F.J. Galloway Associates Inc. AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of entering into an agreement F.J. Galloway Associates Inc. to prepare a Bayham Cultural plan in accordance with their proposal dated July 29, 2004, and modified by correspondence dated August 16th, 2004. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement attached hereto as Schedule "A" and forming part of this by-law, between the Corporation of the Municipality of Bayham and F.J. Galloway Associates Inc., being a contract agreement for the development and production of a Cultural Plan for the Municipality of Bayham. 2. THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 2ND DAY OF SEPTEMBER 2004. 5-1A1 CLERK
