BY-LAW NO.2004-060
BEING A BY-LAW TO AMEND BY-LAW 2003-031
BEING A BY-LAW TO IMPOSE A SEWER RATE
UPON OWNERS OF LAND WHO DERIVE OR WILL
OR MAY DERIVE A BENEFIT FROM SEWAGE WORKS
ARISING FROM NEW DEVELOPMENT.
WHEREAS the Municipal Act, S.O. 2001, as amended provides that the Council of a local
Municipality may by by-law provide for imposing upon owners or occupants of land who use
sewage works a sewage service rate, and;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to
amend such by-law;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
THAT Section 3(b)(i)be repealed and replaced with:
3(b)(i) Owners in the deferred benefit areas who become liable for sewer rates shall, prior
to the connection of their lot to the sewer system, either pay their respective sewer
rates in full or elect to pay in either ten (10) or fifteen(15) annual installments and
pay the first installment.
AND THAT the following section be added:
3(b)(iii) The annual installments of owners who elect to pay in either ten(10) or fifteen(15)
annual installments will include an interest charge at a rate of interest determined
by the Treasurer to be the rate at which the Municipality would pay on debentures
issued as of the date on which the owner's lot was connected to the sewer system.
READ A FIRST,SECOND AND THIRD TIME AND FINALLY PASSED THIS 15TH DAY
OF JULY 2004.
