BY-LAW NO. 2004-049
A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK
TO EXECUTE A SITE PLAN AGREEMENT BETWEEN
THE MUNICIPALITY OF BAYHAM AND ROBERT LEON VALCKE
REGARDING PART OF LOT 131 CONCESSION 7 N.S.T.R.
WHEREAS Section 41 of the Planning Act,R.S.O. 1990, as amended,provides in part that,
where in an Official Plan an area is shown or described as a proposed site plan control area,the
Council of the local municipality in which the proposed area is situate may,by by-law, designate
the whole or any part of such area as a site plan control area;
AND WHEREAS the Municipality of Bayham is covered by an approved Official Plan that
describes the entire municipality as a potential site plan control area;
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to enter into a
Site Plan Agreement with Robert Leon Valcke for an existing recycling depot at 57446 Heritage
Line, RR 1 Straffordville.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Site Plan
Agreement between the Municipality of Bayham and Robert Leon Valcke appended
hereto as Schedule"A"and forming part of this By-law.
2. THAT this By-law shall take effect upon the date of its passing.
3. THAT this By-law and the said Site Plan Agreement shall be registered in the Land
Registry Office for the Registry Division of Elgin No. 11.
READ A FIRST AND SECOND TIME this 6th day of May 2004.
READ A THIRD TIME AND FINALLY PASSED this 6th day of May 2004.
