BY-LAW NO. 2004-045
A BY-LAW TO AUTHORIZE THE EXECUTION
OF AN AGREEMENT BETWEEN THE
MUNICIPALITY OF BAYHAM
AND
COUNTY OF ELGIN
WHEREAS the Council of the Corporation of the Municipality of Bayham adopted By-law No.
2003-059 July 3, 2003, to authorize an agreement with the County of Elgin for the provision of
maintenance of County Roads.
AND WHEREAS the said agreement includes establishment of Minimum Maintenance
Standards for County Roads.
AND WHEREAS the County of Elgin, by by-law adopted in September 2003, amended such
Minimum Maintenance Standards to reflect standards adopted by the Province of Ontario by
Regulation 239/02.
AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of
entering into an agreement with the County of Elgin to amend the current Road Maintenance
Agreement to reflect the new minimum maintenance standards.
NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE
MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement
attached hereto as Schedule"A" and forming part of this by-law between the Corporation
of the County of Elgin and the Corporation of the Municipality of Bayham,being an
agreement respecting the maintenance of County Roads.
2. THAT this by-law shall come into full force and effect upon final passing.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 6T0 DAY
OF MAY,2004.
