BY-LAW NO.2003-087
A BY-LAW TO AMEND BY-LAW 2002-49,
BEING A BY-LAW TO PROVIDE FOR DRAINAGE WORKS IN
THE MUNICIPALITY OF BAYHAM IN THE
COUNTY OF ELGIN (SPROUL EXTENSION& BRANCH("A")
WHEREAS the Council of the Municipality of Bayham in the County of Elgin in accordance with the
Sections 4 and 78 of the Drainage Act, R.S.O. 1990, on September 19, 2002 by By-law 2002-49 adopted
Engineer's Report No. 97099, prepared by Spriet Associates, dated May 17, 2002 with an estimated total
cost of $119, 900.00 to construct the drainage works on the lands and roads described.as:
Part of Lots 1 to 4,Concessions 1 and 3, in the Municipality of Bayham,
in the County of Elgin;
AND WHEREAS the actual cost of the construction has now been determined to be$123,445.13
AND WHEREAS $123,445.13 is the amount to be contributed by the municipality for construction of the
drainage works on the above noted lands;
AND WHEREAS Council deems it expedient to amend the schedule of net assessment to reflect a total cost
of $123,445.13
NOW THEREFORE the Council of the Municipality of Bayham enacts as follows:
THAT the actual costs of the drainage works attached hereto as Schedule"A"amending the Schedule ofNet
Assessment attached to By-law 2002-49 is hereby adopted;
THAT The Corporation of the Municipality of Bayham may borrow,on the credit of the Corporation,the
amount of$123,445.13,being the amount necessary for construction of the drainage works;
THAT all other terms and conditions of By-law 200$249 are hereby confirmed;
AND THAT this by-law shall come into full force and effect upon the passing thereof
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 2" DAY OF
OCTOBER 2003.
