(PORT BURWELL) The following text and map schedule constitute Amendment Number 2 to the Official Plan of the Municipality ofBayham F:IWORDWY-LAWS12003\009Spe OPA.doc OFFICIAL PLAN OF THE MUNICIPALITY OF BAYHAM THE attached text and map schedule constituting Amendment No.2 to the Official Plan of the Municipality of Bayharn was prepared upon the recommendation of the Council of the Municipality of Bayham after evaluation of public input pursuant to the provisions of the PLANNING ACT. THIS Amendment was adopted by the Council of the Corporation of the Municipality of Bayham by By-law No. 2003-008, in accordance with Section 17 of the PLANNING ACT, on the 23rd day of January 2003. THAT Amendment No. 2 to the Official Plan of the Municipality of Bayham consisting of the attached text and map schedule is hereby adopted. 2. THAT the Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs and Housing for approval of the aforementioned Amendment No.2 to the Official Plan of the Municipality of Bayham. 3. PURPOSE The purpose of this amendment is to change the land use designation on lands in the Municipality of Bayham from"Residential"to"Multi-Unit Residential"in the Official Plan of the Municipality of Bayham. The amendment is intended to permit the conversion of a duplex dwelling to a triplex dwelling. 2. LOCATION The area affected by this amendment comprises approximately 1,044 m2(0.25 acres)and is occupied by an existing two-unit converted dwelling. The subject lands are situated on the northwest corner of Wellington Street and Strachan Street,in the Village of Port Burwell,in the MunicipalityofBayham. 3. BASIS OF THE AMENDMENT The subject lands are located in an area consisting mainly of single-detached residential dwellings with several similar converted dwellings located throughout the general area. The central business district of the Village of Port Burwell is located approximately two blocks to the west of the subject lands. Abutting land uses include single-detached dwellings to the north, south and west of the subject lands,while an elementary school,church,and cemetery are located immediately east of the subject lands. The attached Schedule "B" shows the existing land use of the neighbourhood surrounding the subject lands. Section 1.2.1 d)of the Provincial Policy Statement states that municipalities shall encourage all forms of residential intensification in built-up areas that have sufficient infrastructure for the proposed development. The development would have access to municipal water and sewage disposal services, and have existing vehicular access to an open paved municipal road(Strachan Street). In addition,Section 4.4.3 lists criteria for the development of multi-unit residential uses. The proposal would comply with the maximum net density of 35 units per hectare,with an approximate net density of 30 units per hectare. An area for four off-street parking spaces could be accommodated on-site as per the parking standards for multi-unit dwellings. It has been determined that the addition of one extra dwelling unit in the existing building would not create any undue strain on the Municipality's water and sewer systems,nor on the surrounding road network. It has also been determined that the extra dwelling unit would not have a negative impact on surrounding residential land uses,pedestrian and vehicular traffic patterns, or the local school system. The lands subject to this amendment would accommodate the conversion of duplex dwelling to a triplex dwelling pursuant to the approval of an implementing Zoning By-law Amendment. 4. DETAILS OF THE AMENDMENT i) Schedule"A"Future Land Use of the Official Plan of the Township of Bayham is hereby amended by changing from"Residential"to "Multi-Unit Residential" those lands marked "Multi-Unit Residential" on the attached Schedule"A",which shall constitute part of this amendment. ii) The lands subject to this Amendment and designated"Multi-Unit Residential"maybe used, developed and zoned in accordance with the Multi-Unit Residential designation policies of Section 4.4.3 of the Official Plan, as anxnded.
