THAT the Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs and Housing for approval of the aforementioned Amendment No. 108 to the Official Plan of the Township of Bayham, 3. THAT no part of this By-law shall come into force and take effect until approved by the Minister of Municipal Affairs and Housing. PURPOSE The purpose of this amendment is to change the land use designation on lands in the Municipality of Baybam from"Agriculture"to"Rural—Estate Residential" in the Official Plan of the Township of Bayham. The amendment is intended to facilitate the creation of three non-farm residential lots which will accommodate one existing dwelling, and the development of two new dwellings. 2. LOCATION The area affected by this amendment comprises approximately 6.1 hectares(15.1 acres). The subject lands are situated on the west side of Elliot road,south of Green Line,in Part Lot 15, Concession 10, in the Municipality of Bayham. 3, BASIS OF THE AMENDMENT The subject lands are situated along a stretch of Elliot Road from Green Line on the north to Talbot Line on the south, that consists solely of estate residential, rural commercial and institutional uses. These uses are separated from larger agricultural holdings to the west by a significant wooded area that runs almost entirely from.Green Line to Talbot Line. Based on the size of the subject lands, their extensive wooded coverage, and the extent of existing, adjacent residential development to both the north and south, the subject lands exhibit virtually no viability for agricultural use. Section 4.3 of the Official Plan of the Township of Bayham states that proposals for non- farm development in the "Agriculture" designation will be subject to site-specific amendments to the Official Plan,subject to the conditions outlined in Section 4.3.1.4 of the Plan. The proposal complies with 9 of the 10 criteria,needing only written approval from the Elgin-St.Thomas Health Unit for two new,private water and sewage disposal systems in order to comply with ALL necessary criteria. The proposed lots would have frontage on an opened public road; they would not be in proximity to any high nuisance land uses;they would comply with the Minimum Distance Separation Formula 1; they would not be in proximity to any hazardous lands; nor would they create any undue traffic bs7ards; they would not affect any natural resource areas or detract from the rural environment;they are nearly identical in size to surrounding residential lots and they are physically removed from the prime agricultural area by Elliot Road to the east and the large woo dlot to the west. Schedule"B"to this amendment shows the existing lot structure and land use relationships around the subject lands. The lands subject to this amendment could accommodate two(2)new residential dwellings pursuant to the approval of an implementing Zoning By-law Amendment. 04.03/2001 09:42 FAX 519 472 9354 Cumming Cockburn Ltd 3 BAYHAM 2006 4. DETAILS OF THE AMENDMENT i) Schedule"A"Future Land Use of the Official Flan of the Township of Bayham is hereby amended by changing from "Agriculture" to "Rural -- Estate Residential" those lands marked"Rural.--Estate Residential"on the attached Schedule"A",which schedule shall constitute part of this amendment. ii) That the Official Plan of the Township of layham, as amended, is hereby further amended by the addition of Section 4.3.2.5 u)as follows; "a parcel having an approximate size of 6.1 hectares and situated on the west side of Elliot Road in Part Lot 15, Concession 10.
