BY-LAW NO. 2000-106
BEING A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO
EXECUTE AN AGREEMENT WITH K.C.EMERSON ENTERPRISES
LIMITED AM)RANDALL AND DEBORAH PETTIGREW RESPECTING
THE VIENNA/STRAFFORDVILLE/EDEN SANITARY SEWER PROJECT
WHEREAS K.C. Emerson Enterprises Limited is the owner of lands in the Municipality
of Bayham described as Concession 3 N Pt Lot 15, Plan 54 Pt Lots 13 and14, identified
by Municipal Roll Number 34-01-000-002-05400-0000;
AND WHEREAS Randall Pettigrew is the owner of lands in the Municipality of
Bayham described as Concession 3 N Pt Lot 15, Plan 54 Pt Lots 13 and14, identified by
Municipal Roll Number 34-01-000-002-05500-0000;
AND WHEREAS the Municipality of Bayham is constructing sanitary sewer services to
service the communities of Vienna, Straffordville, and Vienna, and such sewers will not
service the said properties.
AND WHEREAS K.C. Emerson and Randall Pettigrew desire arrangements to be made
such that sanitary sewers services will cross the frontage of the said properties, the cost of
which to be borne fully by the said owners;
AND WHEREAS the Council of the Municipality of Bayham deems it expedient to
authorize the Mayor and CIerk to enter into and execute an agreement on behalf of the
Municipality, to provide for installation of gravity sewers across the frontages of the said
properties at the full cost of the applicants;
THEREFORE the Council of the Corporation of the Municipality of Bayham enacts as
follows:
1. THAT the agreement affixed hereto and forming part of this by-law, and marked
Schedule "A", be and the same is hereby approved, and the Clerk and Mayor are hereby
authorized and directed to execute the same.
2. THAT this by-law shall come into full force and effect upon final passing.
