HomeMy WebLinkAboutBy-law No. 2000-077 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2000-77 A BY-LAW TO AUTHORIZE THE EXECUTION OF AN AGREEMENT BETWEEN THE MUNICIPALITY OF BAYHAM AND CLEASON HOOVER AND SALINDA HOOVER FOR A MUTUAL AGREEMENT DRAIN CONSTRUCTION AND MAINTENANCE WHEREAS Chapter D17 Section 2 of the Drainage Act R.S.O., 1990 provides for two or more owners of land to enter into a written agreement for the construction and maintenance of drainage works on their lands; AND WHEREAS the Owners, being: (a) The Corporation of the Municipality of Bayham owner of certain lands and premises described as Part Lot 112, Concession North Talbot Road, in the Municipality of Bayham, County of Elgin, geographic Township of Bayham designated as Road Allowance Plan 11R-7329 Registered Plan 22 Parts 9 and Part 8 known as Plank Road intersecting Richmond Street; and (b) Cleason Hoover and Salinda Hoover owners of certain lands and premises described as South Half Lot 112, Concession 7 North Talbot Road and North Part Lot 112, Concession 7 South Talbot Road, in the Municipality of Bayham, County of Elgin, geographic Township of Bayham described as Parts 1, 2, 3, 5 11R-2204 Assessment Roll # 3401-000-007-05400-0000. AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of entering into an agreement with Cleason Hoover and Salinda Hoover for the construction and maintenance of a mutual drain in the Municipality of Bayham ; AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous that such Agreement be confirmed by by-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF TIM MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement, attached hereto as Schedule "A" and forming part of this by-law, between Cleason and Salinda Hoover and the Municipality of Bayham, for the construction and maintenance of-' a Mutual Agreement Drain in the Municipality of Bayham; 2. THAT this by-law shall come into full force and effect upon final passing. 3. THAT this By-law and Agreement shall be registered in the Land Registry Office for the Registry Division of Elgin No. 11.
