BY-LAW NO. 2000-63
BEING A BY-LAW TO AUTHORIZE THE MAYOR AND ACTING CLERK
TO EXECUTE AN AGREEMENT WITH D'AMORE CONSTRUCTION
(WINDSOR)LIMITED FOR THE CONSTRUCTION OF THE VIENNA
SANITARY SEWERS IN THE MUNICIPALITY OF BAYHAM
PURSUANT TO PARAGRAPHS 207(13)AND 210(84) OF THE
MUNICIPAL ACT,R.S.O. 1990,CHAPTER M.45,AS AMENDED.
WHEREAS the Council of the Municipality of Bayham deems it expedient to authorize
the Mayor and Acting Clerk to execute a contract on behalf of the Municipality, for the
construction of the Vienna Sanitary Sewers based on and in accordance with the terms
and conditions of the tender received June 21st,2000 from D'Amore Construction
(Windsor) Limited;
AND WHEREAS the Corporation of the Municipality of Bayham(the"Municipality")
desires to enter into an agreement with D'Amore Construction(Windsor) Limited for
construction of the Vienna Sanitary Sewers in accordance with Contract No.8 as prepared
by the Ontario Clean Water Agency;
NOW THEREFORE the Council of the Corporation of the Municipality of Bayham
enacts as follows:
1. THAT the Municipality enter into and execute an Agreement with D'Amore
Construction(Windsor)Limited for construction of the Vienna Sanitary Sewers in
accordance with Contract No. 8 attached hereto as Schedule"A" and forming part
of this By-Law;
2. THAT the Mayor and the Acting Clerk of the Municipality are hereby authorized
and directed on behalf of the Municipality to execute all documents as may be
required to give effect to these presents.
3. THAT this by-law shall come into full force and effect upon final passing.
