HomeMy WebLinkAboutBy-law No. 2000-050 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2000-50 A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A SITE PLAN AGREEMENT BETWEEN THE MUNICIPALITY OF BAYHAM AND MARC SERGE VEZINA, JACQUELEEN BECKY VEZINA AND GRETCHEN BOLT REGARDING PART LOT 21,PLAN 205, DESIGNATED AS PARTS 1 AND 2,PLAN 11R-7227 WHEREAS the Council of the Corporation of the Municipality of Bayham in its consideration of a request for comments by the County of Elgin Land Division Committee with respect to Consent Application E-70/99 enacted and passed Resolution No. 99-463 on August 19, 1999 setting out recommended conditions for the granting consent to sever a parcel of land described as Part Lot 21,Plan 205, designated as Part 2 on Reference Plan 11R-7227; AND WHEREAS the Decision of the County of Elgin Land Division Committee for the said application contained the conditions recommended by the Municipal Council and further required the applicants to install a six foot high wooden privacy fence along the south side yard to be erected entirely on the severed lot at the expense of the applicant/owner to the satisfaction of the Chief Building Official; AND WHEREAS in order for the Owners to comply with the conditions of severance, and the Municipality to confirm that the said conditions have been satisfied whereby title to the severed parcel can be transferred, it has been deemed and is mutually agreeable to the parties, being Marc Serge and Jacqueleen Becky Vezina as current Owners and Gretchen Bolt as the Purchaser of Part 2, on Reference Plan 11R-7227 and the Municipality of Bayham to enter into a Site PIan Agreement setting out mutual covenants; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Site Plan Agreement attached hereto as Schedule"A" and forming part of this by-law between the Municipality of Bayham and Marc Serge Vezina and Jacqueleen Becky Vezina and Gretchen Bolt having reference to the conditions imposed by the Elgin County Land Division Committee in its Decision dated October 6, 1999 for Application No. E-70/99. 2. THAT this By-law shall come into full force and effect upon the date of its enactment. 3. THAT this By-law and Agreement shall be registered in the Land Registry Office for the Registry Division of Elgin No. 11.
