BY-LAW NO. 2000-49
A BY-LAW TO AUTHORIZE THE EXECUTION
OF AN AGREEMENT BETWEEN THE MUNICIPALITY
OF BAYHAM AND PETER PAUL AND MARY AGNES
DECLOET REGARDING A CONDITION OF THE ELGIN
COUN'T'Y LAND DIVISION COMMITTEE DECISION FOR
CONSENT APPLICATION E-53199, PART LOT 22,
CONCESSION 9, HAMLET OF EDEN
WHEREAS the Owners, being Peter Paul DeCIoet and Mary Agnes DeCloet hold registered
title to certain lands and premises described as Part of Lot 22, Concession 9, in the Municipality
ofBayham, County of Elgin, geographic Township ofBayham designated as Part 1 on Reference
Plan 11R-7054 and Part 6 on Reference Plan 11R-5905;
AND WHEREAS by Decision of the County of Elgin Land Division Committee under Consent
Application No. E-53/99, the said Committee did grant consent pursuant to Section 53(1) of the
Planning Act, R.S.O., 1990, as amended whereby that portion of the Owners' lands and premises
would be severed from the balance of the Owners' lands and premises abutting thereto, subject to
conditions as set out in the Decision dated June 23, 1999;
AND WHEREAS one of the conditions imposed in the said Consent Decision to be performed
to the satisfaction of the Municipality of Bayham related to the installation of a new field bed on
the severed parcel containing the existing single family residential dwelling, field bed and well.
Subsequently, the Municipality has confirmed that a Municipal Sanitary Sewage Project is
proceeding in the year 2000 and the subject severed parcel will be connected by the Current or
Future Owners to the sewage system.
AND WHEREAS in order for the Owners to comply with the conditions of severance, and the
Municipality to confirm that the said condition has been satisfied whereby title to the severed
parcel can be transferred, it has been deemed and is mutually agreeable to the parties,being Peter
Paul DeCloet and Mary Agnes DeCloet and the Municipality ofBayham to enter into an
Agreement setting out mutual covenants;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Agreement
attached hereto as Schedule "A" and forming part of this by-law between the
Municipality of Bayham and Peter Paul DeCloet and Mary Agnes DeCloet having
reference to the treatment of sanitary sewage on the lands described as Part Lot 22,
Concession 9, designated as Part 1 on Plan 1 IR-7054 containing one single family
residential dwelling.
2. THAT this By-law shall come into full force and effect upon the date of its enactment.
3. THAT this By-law and Agreement shall be registered in the Land Registry Office for the
Registry Division of Elgin No. 11,
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 18th
DAY OF MAY, 2000.
