BY-LAW NO. 2000-47
A BY-LAW TO AUTHORIZE THE EXECUTION OF AN
AGREEMENT FOR THE PROVISION OF WATER
SERVICES WITH LEIGHTON MARTIN
WHEREAS Paragraph 3 of Section 308 of the Municipal Act, R.S.O. 1990 Chapter M.45 as
amended, provides in part that municipalities may pass by-laws to permit any person under such
terms and conditions as may be agreed upon to place, construct, install,maintain and use objects in,
on, under, or over sidewalks and highways under is jurisdiction, to permit any person to make,
maintain and use areas under and openings in the highways and sidewalks,for prescribing the terms
and conditions upon which the same are to be placed, constructed, installed, maintained or used and
for making such annual or other charge for the privilege conferred by the by-law as it consider
reasonable.
AND WHEREAS the Municipality of Bayham has by By-law No. 98-21, By-law No. 95-42, and
By-law No. 91-4, established rules and regulations for the operation and maintenance of a system
of waterworks in the Municipality including the connection thereto.
AND WHEREAS the Municipality of Bayham has received from Mr. Leighton Matin, an
application to connect a residence to the Municipal water system with a private connection within
the municipal highway known as Chute Line.
AND WHEREAS the Council of the Municipality of Bayham deems it necessary to approve an
Agreement to permit such connection.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE
MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and they are hereby authorized and directed to execute the
Agreement with Mr. Leighton Martin attached hereto and forming part of this By-law and
marked as Schedule "A", being an agreement to connect to the Municipal water system
with a private connection within the Municipal highway known as Chute Line.
READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 4TH DAY
OF MAY,2000
