HomeMy WebLinkAboutBy-law No. 2000-024 CORPORATION OF THE MUNICIPALITY OF BAY IAM BY-LAW NO. 2000-24 A BY-LAW TO AUTHORIZE THE PURCHASE OF REAL PROPERTY IN THE FORMER VILLAGE OF VIENNA, MUNICIPALITY OF BAYHAM DESCRIBED AS: (1) PART OF LOT 1, SOUTH OF FRONT STREET, EAST OF MAIN STREET (2) LOTS 1 & 2 AND PART OF LOT 3, SOUTH OF FRONT STREET, WEST OF MAIN STREET AND NORTH OF THE ALLEY (3) PART OF LOTS 1, 2 AND 3, SOUTH OF FRONT STREET, WEST OF MAIN STREET AND SOUTH OF THE ALLEY (4) PART OF LOT 6, SOUTH OF FRONT STREET AND WEST OF MAIN STREET AND THE ALLEY LYING TO THE EAST OF THE SAID LOT 6 WHEREAS Section 191 (1) of the Municipal Act, R.S.O. 1990 Chapter M.45 as amended authorizes municipalities to pass by-laws for acquiring or expropriating any land required for the purposes of the corporation, and for erecting and repairing buildings thereon, and for making additions to or alterations of such buildings, and may sell or otherwise dispose of the same when no longer required; AND WHEREAS Section 207 (52) authorizes municipalities to pass by-laws for acquiring real property for the purpose of establishing public parks; AND WHEREAS the Council of the Municipality of Bayham is desirous of acquiring real property for the purpose of the corporation, for a sum of fourteen thousand, three hundred and fifty dollars ($14,350.00),plus legal fees and land transfer tax, for property located in the former Village of Vienna,Municipality of Bayham, described as: (1) Part of Lot 1, south of Front Street and east of Main Street (2) Part Lots 1 and 2 and Part Lot 3, south of Front Street, west of Main Street and north of the alley (3) Parts of Lots 1, 2 and 3, south of Front Street, west of Main Street and south of the alley (4) Part of Lot 6, south of Front Street and west of Main Street and the alley lying to the east of the said lot 6 AND WHEREAS the Council of the Municipality of Bayham deems it necessary to approve the Agreement of Purchase and Sale by by-law; By-law 2000-24 Page 2 NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Council of the Municipality of Bayham authorize the Mayor and Clerk to execute such documents as may be necessary to provide for the purchase of real property from Hulme Pattinson being: (1) Part of Lot 1, south of Front Street and east of Main Street (2) Part Lots 1 and 2 and Part Lot 3, south of Front Street, west of Main Street and north of the alley (3) Parts of Lots 1, 2 and 3, south of Front Street, west of Main Street and south of the alley (4) Part of Lot 6, south of Front Street and west of Main Street and the alley lying to the east of the said lot 6 2. THAT the purchase price be fourteen thousand, three hundred and fifty dollars ($14,350.00), plus legal fees and land transfer tax, payable to the Vendor on March 17, 2000; 3. AND THAT the said Agreement of Purchase and Sale is attached hereto as Schedule "A" and forms part of this By-law. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 16TH DAY OF MARCH,2000 MAYO' CLERK
