HomeMy WebLinkAboutBy-law No. 1999-097 CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 99-97 A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A QUIT CLAIM DEED FOR LANDS DES- CRIBED AS SOUTH PART LOT 15, CONCESSION 3, DESIGNATED AS PART 1, REFERENCE PLAN 11R-1579 IN THE MUNICIPALITY OF BAYHAM (BRYAN AND GUNDY GOUTOUSKI) WHEREAS the Council of the Corporation of the Township of Bayham enacted and passed By-law No. 96-44 on July 18`h, 1996 to authorize the Reeve and Clerk to enter into a site plan agreement pursuant to Section 41 of the PLANNING ACT, and the said Agreement and By-law were registered in the Land Registry Office for the Registry Division of Elgin No. 11 on August 28, 1996 as Instrument No. 371571; AND WHEREAS the legal description of the subject property contained an error in the said Agreement and By-law and therefore By-law No. 98-29 was enacted and passed on April 2, 1998 and subsequently registered in the said Land Registry Office on August 11, 1998 as Instrument No. 387622 for the correct parcel of land; AND WHEREAS the owners of the parcel described as the South Part of Lot 15, Concession 3, designated as PART 1 on Plan 11R-1579, being Bryan and Gundy Goutouski and their solicitor have requested the Municipality of Bayham to execute a Quit Claim Deed to effect the sale of the subject parcel; THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute a Quit Claim Deed for lands described as Part Lot 15, Concession 3, designated as PART 1 ON Plan 11R-1579. 2. THAT this By-law shall take effect upon the date of its passing. 3. THAT this By-law and the Quit Claim Deed shall be registered in the Land Registry Office for the Registry Division of Elgin No. 11.
