BY-LAW NO.99-42
BEING A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO
EXECUTE A MUTUAL RELEASE WITH JAMES BRADLEY HOWE
AND RONALD CRAIG HOWE WITH RESPECT TO PROPERTY
DESCRIBED AS PART LOT 17, CONCESSION 3,DESIGNATED AS
PART 1 ON REFERENCE PLAN NUMBER 11R-6249
WHEREAS the Council of the Corporation of the Village of Vienna entered into an Agreement
of Purchase and Sale on December 21, 1995 for the purchase of a 17 acre parcel of land owned
by James Bradley Howe and Ronald Craig Howe, said lands described as Part Lot 17,
Concession 3, designated as PART 1 on Reference Plan Number 11R-6249;
AND WHEREAS the purpose for acquiring the lands was to permit the construction and
operation of a municipal sanitary sewage disposal works on the property;
AND WHEREAS the said Agreement of Purchase and Sale expired on the 7th day of March,
1999;
AND WHEREAS the Corporation of the Village of Vienna together with the Corporation of the
Village of Vienna and the Corporation of the Township of Bayham were restructured as the
Corporation of the Municipality of Bayham by Order of the Minister of Municipal Affairs and
Housing dated May 15, 1997 and November 27, 1997 respectively, said amalgamation to be
effective commencing on January 1, 1998;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham does not deem
it necessary to pursue the said purchase and the lands have subsequently been sold to David G.
Howe and Rosemarie A. Ungar;
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Clerk be and are hereby authorized to execute the Mutual Release
attached hereto and forming part of this by-law. The said Release was executed by James
Bradley Howe and Ronald Craig Howe on May 26th, 1999.
2. THAT any and all council resolutions and/or by-laws enacted and passed by the former
Village of Vienna in this regard be and are hereby rescinded.
3. THAT this By-law shall take effect upon the date of its passage.
READ A FIRST AND SECOND TIME this 21st, day of June, 1999.
READ A THIRD TIME AND FINALLY PASSED this 21's,day of June, 1999.
