BY-LAW NO.99-27
BEING A BY-LAW TO AUTHORIZE THE MAYOR AND
ADMINISTRATOR-TREASURER TO SIGN AMENDED
SCHEDULES "A"AND "B" TO AN AGREEMENT WITH
HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO AS
REPRESENTED BY THE ONTARIO CLEAN WATER AGENCY
WITH RESPECT TO PROPOSED WATER AND SEWAGE
WORKS PROJECTS FOR THE COMMUNITIES OF EDEN
AND STRAFFORDVILLE
(FORMER TOWNSHIP OF BAYHAM BY-LAW 96-46)
WHEREAS Section 10, sub-section 2 of the Ontario Water Resources Act, R.S.O. 1990,
Chapter 0.40, as amended authorizes the Crown, represented by the Minister, to make
agreements with any one or more persons with respect to a supply of water or the reception,
treatment and disposal of sewage;
AND WHEREAS Section 11 of the said Act authorizes municipalities to enter into agreements
with the Crown under subsection 10(2);
AND WHEREAS the Council of the former Township of Bayham on August 1, 1996 passed
By-law 96-46 to enter into an Agreement with the Ontario Clean Water Agency to set out the
terms of the project management services for the Straffordville/Eden Environmental Study
Reports;
AND WHEREAS it is now deemed advisable to amend the said Agreement with the Ontario
Clean Water Agency;.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Mayor and Administrator-Treasurer be and are hereby authorized to execute
an amendment to Schedules "A" and"B" of the said Agreement with the Ontario Clean
Water Agency, as attached hereto and forming part of this By-law;
2. THAT this By-law shall come into full force and effect upon final passing.
READ A FIRST AND SECOND TIME this 1st day of APRIL, 1999.
READ A THIRD TIME AND FINALLY PASSED this 1st day of APRIL, 1999.
