BY-LAW NO. 98-100
BEING A BY-LAW TO AUTHORIZE TILE MAYOR AND CLERK
TO EXECUTE A LEASE AGREEMENT BETWEEN THE
MUNICIPALITY AND TERRY AND GAYLE SIMMONS FOR THE
LEASE OF A PORTION OF THE LANDS DESCRIBED AS PLAN 12 LOT
2 TO 5 W/S ERIEUS, PLAN 12 LOT 3 TO 5 E/S ROBINSON BEING 1.10
ACRES,IN THE MUNICIPALITY OF BAYHAM(FORMERLY VILLAGE
OF PORT BURWELL), COUNTY OF ELGIN
WHEREAS pursuant to the Short Forms of Leases Act,the Landlord and Tenant Act and
Amendments, Terry and Gayle Simmons have offered to lease Municipal owned vacant land to
permit the temporary installation of a mobile trailer unit for the purposes of operating a food
booth;
AND WHEREAS the Council of the Corporation of the Municipality of Bayham and Terry and
Gayle Simmons have reached an agreement setting out the terms and conditions of the lease.
THEREFORE THE COUNCIL OF THE CORPORATION OF "THE MUNICIPALITY
OF BAYHAM ENACTS AS FOLLOWS:
1. THAT the Agreement attached hereto and forming part of this By-law between
the Corporation of the Municipality of Bayham and Terry and Gayle Simmons setting out
the terms and conditions for Terry and Gayle Simmons to lease a portion of the
Municipal owned vacant land composed of Plan 12 Lot 2 to 5 W/S Erieus, Plan 12 Lot 3
to 5, E/S Robinson being 1.10 acres, in the Municipality of Bayham (formerly the Village
of Port Burwell), and more specifically identified on Schedule "B" to the Agreement is
hereby approved.
2. THAT the Mayor and Clerk be hereby authorized to execute the attached agreement
marked as Schedule "A" on behalf of the Corporation.
3. AND THAT By-law 98-30 and the attached agreement with Jack and Norma Vince be
hereby repealed.
READ A FIRST AND SECOND TIME this 3r1 day of DECEMBER, 1998.
READ A THIRD TIME AND FINALLY PASSED this 3rd day of DECEMBER, 1998.
