BY-LAW NO. 98-71
A BY-LAW TO AMEND A REPORT FOR A DRAINAGE
WORKS IN THE MUNICIPALITY OF BAYHAM,
FORMERLY TOWNSHIP OF BAYHAM IN THE COUNTY
OF ELGIN. (WHITE DRAIN)
WHEREAS a Report dated August 10, 1937 adopted by the Council of the Municipality of
Bayham, formerly Township of Bayham in the County of Elgin in accordance with Section 4 of the
Drainage Act,R.S.O. 1990, for drainage works on lands described as:
Part of Lots 21 and 22, Concessions 8, in the Municipality of
Bayham, formerly Township of Bayham in the County of Elgin;
AND WHEREAS, the Council of the former Township of Bayham in the County of Elgin has
procured a report made by Fred A. Bell, Civil Engineer dated August 10, 1937,.a copy of which is
attached hereto and forms part of this By-Law;
AND WHEREAS the original cost of constructing the drainage work was apportioned among
benefiting property owners in 1937;
AND WHEREAS in accordance with Section 74 of the Drainage Act, R.S.O. 1990, future
maintenance on the drainage works is incurred at the expense of all the upstream lands and roads in
any way assessed for the construction or improvement of the drainage works and in proportion
determined by the then current by-law;
AND WHEREAS since the time of construction the benefiting property roll numbers have been
reconfigured to conform with property splits;
NOW THEREFORE the Council of the Municipality of Bayham finds enacts as follows:
1. The report dated August 10, 1937 and the amended assessment schedule as prepared by
Spriet Associates attached hereto is hereby adopted and any repair, maintenance or
improvement to the drainage works as required shall be completed in accordance therewith.
2. This by-law comes into force on the passing thereof and may be cited as"White Drain".
3. That any by-law previously passed by the former Corporation of the Township of Bayham
with regard to the"White Drain"be hereby repealed.
