BY-LAW NO. 98-68
BEING A BY-LAW TO AUTHORIZE THE MAYOR AND DEPUTY
CLERK TO EXECUTE AN AGREEMENT BETWEEN THE
MUNICIPALITY AND RICHELLE WHITE FOR THE CONSTRUCTION,
RECONSTRUCTION, REPAIR, MAINTENANCE AND KEEP. ING OF A
LINE FENCE ON THE BOUNDARY OF ADJACENT PROPERTIES
SITUATED AT PLAN 113 PART LOT 1, W/S MAIN, PART 1 N/S FIRST,
MUNICIPALITY OF BAYHAM, COUNTY OF ELGIN
WHEREAS pursuant to the Line Fences Act, R.S.O. 1990, c. L.17, s.23, the council of a
municipality or a local board may enter into agreements with owners of land adjoining land
owned by the municipality or the local board, as the case may be, for the construction,
reconstruction, repair, maintenance and keeping up of line fences to mark the boundary of such
lands,and any such agreement when reduced to writing in the prescribed form may be registered
and enforced;
AND WHEREAS the Adjacent Land Owner,the respective owner of lands described as Plan
113 Part Lot 1, west side Main, Part Lot 1 north side First and the Municipality,the respective
owner of lands described as Plan 113 Part Lot 1,west side Main,Part Lot 1 north side First are
abutting property owners sharing a common boundary.
AND WHEREAS the Adjacent Land Owner and the Municipality are desirous of entering into
an agreement,made pursuant to the above Act,for the construction,reconstruction,repair,
maintenance and keeping up of the line fence.
THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF
BAYHAM ENACTS AS FOLLOWS:
1. THAT the Agreement attached hereto and forming part of this By-law between
the Corporation of the Municipality of Bayham and Richelle White setting out the terms
and conditions for a Line Fence for adjacent properties situated at Plan 113, Part Lot 1,
W/S Main, Part 1 N/S First, Municipality of Bayham, County of Elgin is hereby
approved.
2. THAT the Mayor and Deputy Clerk be hereby authorized to execute the attached
agreement marked as Schedule "A"on behalf of the Corporation.
READ A FIRST AND SECOND TIME this 30th day of JULY, 1998.
READ A THIRD TIME AND FINALL 'ASSED this 30th day of JULY, 1998.
