HomeMy WebLinkAboutBy-law No. 1998-038 CORPORATION OF THE TOWNSHIP OF BAYHAM BY-LAW NO. 98-38 BEING A BY-LAW TO AUTHORIZE THE MAYOR TO EXECUTE A LICENCE OF OCCUPATION AGREEMENT BETWEEN THE MUNICIPALITY AND THE ST. THOMAS FIRE DEPARTMENT AND THE NORFOLK CO-OPERATIVE COMPANY, LIMITED TO ALLOW THE ST. THOMAS FIRE DEPARTMENT TO INSTALL, OPERATE AND MAINTAIN MOBILE RADIO REPEATER EQUIPMENT ON PROPERTY OWNED BY THE NORFOLK CO-OPERATIVE COMPANY, LIMITED. WHEREAS pursuant to the Short Forms of Leases Act, the Landlord and Tenant Act and Amendments, Norfolk Co-operative Company, Limited has offered a licence agreement to allow the St. Thomas Fire Department and the Municipality of Bayham to enter the premises for the purpose of installing, operating and maintaining mobile radio repeater equipment to be used for emergency dispatch services, the premises of which is property owned by the Norfolk Co- operative Company, Limited legally described Part Lots 16 and 17, Concession South Gore, in the Municipality of Bayham; AND WHEREAS the Council of the Corporation of the Municipality of Bayham, the St. Thomas Fire Department and the Norfolk Co-operative Company, Limited have reached an agreement setting out the terms and conditions of the Licence. THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Agreement attached hereto forms part of this By-law between the Corporation of the Municipality of Bayham, the St. Thomas Fire Department and the Norfolk Co-operative Company, Limited, setting out the terms and conditions for the St. Thomas Fire Department and the Municipality of Bayham to enter upon lands owned by the Norfolk Co-operative, Limited composed of Part Lots 16 and 17, Concession South Gore, in the Municipality of Bayham, County of Elgin. 2. THAT the Mayor be hereby authorized to execute the attached agreement marked as Schedule "A" on behalf of the Corporation. READ A FIRST AND SECOND TIME this 7th day of MAY, 1998.
