HomeMy WebLinkAboutZoning By-law No. Z729-2021MUNICIPALITY OF BAYHAM DEPUTY CLERK'S CERTIFICATE Section 34(22) of the Planning Act, R.S.O. 1990, Chapter P. 13 I, Margaret Underhill, Planning Coordinator and Deputy Clerk hereby certify that the notice for By-law No. Z729-2021 of the Corporation of the Municipality of Bayham Read a First and Second and Third Reading and finally passed by the Council of the Corporation on the 19th day of August 2021 was given in the manner and form and to the persons prescribed by regulations made by the Lieutenant Governor -in -Council under Section 34 of the Planning Act. I also certify that the 20-day objection period expired on the 9th day of September 2021 and to this date, no notice of objection has been filed under Section 34(19) by any person in the office of the Clerk. PENN THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. Z729-2021 PENNER BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By-law No. Z456-2003, as amended; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Schedule "A" Map No. 6 by changing the zoning symbol on the lands from Agriculture (Al) zone to a site -specific Agriculture (A1-41) zone, which lands are outlined in heavy solid lines and marked A1-41 on Schedule "A" Map No. 6 to this By-law, which schedule is attached to and forms part of this By-law. ) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 5.12 Exception — Agricultural (Al) Zone by adding the following clauses: 5.12.41.1 Defined Area Al-41 as shown on Schedule "A", Map No. 6 to this By-law. 5.12.41.2 Permitted Uses Garden supply centre, in addition to all other permitted uses in the Al zone. 5.12.41.3 Permitted Buildings and Structures Maximum combined building floor area of 1,265 m2 in the form of three connected portions including two greenhouses and one gift shop / office Maximum fourteen (14) concrete bunkers for landscape supplies In addition to the existing dwelling and barn. 5.12.41.4 Minimum Lot Area 12.4 hectares 5.12.41.5 Minimum Side Yard Setback 4.0 m north side for concrete structures associated with garden supply centre 3) THIS By-law comes into force: a} Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Local Planning Appeal Tribunal.
