Z299-94 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended by amending Section 9, Hamlet Commercial (HC) Zone Regulations by adding a new subsection to Section 9.9 EXCEPTIONS - HC Zone as follows: "9.9.3 9.9.3.1 Defined Area HC-3 as shown on Schedule "K, Map 82 to this By-law. 9.9.3.2 Permitted Uses An apartment dwelling unit which is not accessory to the commercial use in addition to all other uses permitted in the Hamlet Commercial (HC) Zone." 2. If the applicant can satisfy our concerns as to his ability to establish a proposed coffee shop on the subject land, then we will be in a position to review his other proposal to create an apartment dwelling unit. After April 1, 1994 the applicant can conduct the required percolation test or prior to that he can have a soils consultant establish the percolation rate on the basis of laboratory tests. One of the foregoing is needed to make a final determination on the coffee shop proposal. Consequently, we believe that the request for the zoning by-law amendment for the apartment dwelling unit is premature at this time and should be deferred. The Township Council at its March 3, 1994, meeting adopted By-law No. Z299/94 to permit the creation of an accessory apartment at the above-noted property. Council considered the Health Unit's position on this matter and determined the issuance of a Certificate of Approval could be handled at the building permit stage. As you aware our Chief Building Official will not issue a building permit unless certification is received from the Health Unit. Council was of the opinion commencement of the zoning process would assist the applicant in having all approvals necessary except for a Certificate of Approval to be in construction if Health Unit approval is granted.
