HomeMy WebLinkAboutBy-law No. 2019-090 THE CORPORATION OF THE MUNICIPALITY OF BAYHAM BY-LAW NO. 2019-090 A BY-LAW TO AUTHORIZE THE EXECUTION OF A TRANSFER OF LANDS AND TO CORRECT A DEFECT IN TITLE (1 COWPER STREET, PORT BURWELL) WHEREAS Section 8 of the Municipal Act, 2001, S.O.2001,c.25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under this or any other Act; AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of conveying property known as Part Lot 11, Concession 1, Municipality of Bayham, being Parts 2 & 3 of Reference Plan No. 11R-3756 to Ronald Saplak and Judith Saplak as an administrative process pertaining to a title defect correction; AND WHEREAS the Council of the Corporation of the Municipality of Bayham is desirous of retaining easement rights of a portion of the subject land; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF BAYHAM ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk be and are hereby authorized to execute the Transfer of Land attached hereto as Schedule "A" and forming part of this by-law to transfer Part Lot 11, Concession 1, Municipality of Bayham, being Parts 2 & 3 of Reference Plan No. 11 R-3756 to Ronald Sapelak and Judith Sapelak; 2. AND THAT this by-law shall come into full force and effect upon final passing. READ A FIRST, SECOND AND THIRD TIME AND FINALLY PASSED THIS 17th DAY OF OCTOBER, 2019. MAYOR E
