Z682-2019 BRIDGEMAN BEING A BY-LAW TO AMEND BY-LAW No. Z456-2003, AS AMENDED WHEREAS the Council of the Corporation of the Municipality of Bayham deems it necessary to amend Zoning By-law No. Z456-2003, as amended; THEREFORE, the Council of the Corporation of the Municipality of Bayham enacts as follows: 1) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Section 7.13 Exception — Rural Residential (RR) Zone by adding the following clauses: 7.13.36.1 Defined Area RR -36 as shown on Schedule "A" Map No. 4 to this By-law. 7.13.36.2 Definition Cannabis Cultivation -micro, shall mean land, buildings or structures used for the cultivation, planting, growing, and harvesting of Cannabis from the genus of flowering plants in the family Cannabaceae within an enclosed building or structure. The maximum plant floor area of buildings or structures for cultivation -micro, shall not exceed 200 m2. The owner and site shall have a legally valid license and be regulated to operate, in accordance with the applicable Federal and Provincial statutes. The processing, packaging, retail sale and any other accessory use associated with cannabis cultivation is prohibited. 7.13.36.6 Permitted Uses Cannabis Cultivation -micro, in addition to permitted uses in the RR Zone. 7.13.36.3 Supplemental Regulations Outdoor storage of any materials and goods related to the Cannabis Cultivation -micro is prohibited. Accessory building total floor area maximum of 330 m2. 2) THAT By-law No. Z456-2003, as amended, is hereby further amended by amending Schedule "A" Map No. 4 by changing the zoning symbol on the lands from Agriculture (Al) Zone to site-specific Rural Residential (RR -36) Zone, which lands are outlined in heavy solid lines and marked RR -36 on Schedule "A" Map No. 4 to this By-law, which schedule is attached to and forms part of this By-law. 2) THIS By-law comes into force: a) Where no notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the expiration of the prescribed time; or Z682-2019 b) Where notice of objection has been filed with the Municipal Clerk within the time prescribed by the Planning Act and regulations pursuant thereto, upon the approval of the Ontario Municipal Board.
