Z227-90 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No. 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows: 1. THAT By-law No. 2387, as amended, is hereby further amended deleting subsection 6 .12 . 12 in its entirety and replacing it with the following: "6 . 12 . 12 6 . 12 . 12 . 1 Defined Area HR-13 as shown on Schedule 'A' to this By-law. 6 . 12 . 12 .2 Permitted Uses dwelling two-family dwelling three-family, in addition to all other uses permitted in the HR Zone. r 6 . 12. 12.3 Permitted Buildings and Structures Buildings and Structures for the permitted uses. 6 :12 . 12 .4 Minimum Lot Area 1780 . 0 square metres 6 . 12. 12 .5 Minimum Side Yard Width west side 3 . 1 metres east side 6 .2 metres" 2 . THAT By-law No. 2387, as amended, is hereby further amended by amending Section 9, Hamlet Commercial (IIC) Zone Regulations by adding a new subsection to Section 9 .9 Exceptions HC Zone as follows: "9 .9 .2 9. 9 . 2 . 1 Defined Area HC-2 as shown on Schedule 'A' to this By-law 9 .9.2 .2 Permitted Uses office, general office, professional 9. 9 .2. 3 Permitted Buildings & Structures Buildings and Structures for the permitted uses . 2 9 .9 .2.4 Minimum Lot Area 1600.0 square metres 9 . 9 . 2 . 5 Minimum Lot Frontage 21.0 metres 9 .9 .2 .6 Minimum Front Yard Depth 22 .0 metres 9.9 .2 .7 Minimum Side Yard Width North Side, 4 . 5 metres . South Side parallel to First Street, 6 .0 metres 9 .9.2 .8 Minimum Rear Yard Width 22 . 5 metres 9 .9 .2 .9 Minimum Rear Yard Depth 6 .0 metres 9 . 9 .2 . 10 Buffer Area in accordance with Section 4.25 of By-law No. 2387 9 . 9 . 2 . 11 Minimum Off-Street Parkins Spaces Required e eight (8) " 3 . 4 THAT By-law No. 2387, as amended, is hereby further amended by amending Schedule `D' , Map 1 by deleting from the Special Hamlet Residential (HR-13) Zone and adding to the Special Hamlet Commercial (HC-2) Zone, those lands enclosed in heavy solid lines and marked, HC-2 on Schedule 'A' to this By-law, which schedule is attached to and forms part of this By-law. 3 4. THIS By-law comes into force: a) where no notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township's Clerk within the time prescribed by the Planning Act, 1983 and regulations pursuant thereto, upon the approval of the Ontario Municipal Board. REEVE CLERK FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed By-Law No. Z227-90 on the 1st day of March, 1990 under Section 34 of THE PLANNING ACT, 1983. AND TARE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Township of Bayham not later than the 27th day of March, 1990, a notice of appeal setting out the objection to the By-law and the reasons in support of the objection. An explanation of the purpose and effect of the By-law, describing the lands to which the By-law applies, and a Key Map showing the location of the lands to which the By-law applies (or, alternatively an explanation as to why a key map is not provided) are attached. Firstly, it will change the permitted uses and yard provisions for the Special Hamlet Residential (HR--13) Zone on a parcel of land situated on the north side of First Street, east of Highway No. 19 within the Hamlet of Eden in Part Lot23.. , Concession 9 , Township of Bayham. The subject lands are referred to as Part 3 of R.P. 11R-1557 . secondly, it will rezone Part 1 of R.P. 11R-1557 situated on the east side of Highway No. 19 in Part Lot 23 , Concession 9 , in 'the Township of Bayham from the Special Hamlet Residential (HR-13) Zone to the Special Hamlet Commercial (HC-2) Zone. The effect of this By-law will be to expand the permitted uses and revise the yard provisions of the Special Hamlet Residential (HR-13) Zone. This By-law will also permit the construction of a real estate office on the subject lands are zoned Special Hamlet Commercial (HC-2) .
