Z184-89 BEING A BY-LAW TO AMEND BY-LAW NO. 2387 WHEREAS the Council of the Corporation of the Township of Bayham deems it necessary to amend its Zoning By-law No . 2387; THEREFORE, the Council of the Corporation of the Township of Bayham enacts as follows : 1. THAT By-law No. 2387 , as amended, is hereby further amended by amending Section 7 - Rural Residential (RR) Zone Regulations by adding a new subsection to Section 7.11 - Exceptions - RR Zone as follows : "7. 11.6 7. 11.6.1 Defined Area RR-6 as shown on Schedule ' A' , Map 14 to this By-law. 7 . 11 .6. 2 Permitted Uses greenhouses , as an accessory use in addition to all other permited uses in the Rural Residential Zone. 7. 11.6.3 Permitted Buildings and Structures Existing buildings and structures for the permitted uses. 7.11 .6 .4 Accessory Buildings and Structures Permitted buildings and structures for accessory uses shall include greenhouses, and notwithstanding Subsections 4 . 2. 3, 4. 2.4, and 4 . 2. 6 of By-law No . 2387 , as amended , such accessory buildings and structures may be located in the front yard and closer to the front lot line than the main building provided that a minimum setback of thirty-five (35.0) metres is maintained from the front lot line for such accessory buildings and structures and that all accessory buildings and structures shall not exceed seventeen and one half (17. 5%) percent coverage of the total lot area." 2 . THAT By-law No . 2387, as amended , is hereby further amended by amending Schedule 'A' , Map 14 by deleting from the Agricultural (Al) Zone and adding to the Special Rural Residential (RR-6) Zone, those lands enclosed in heavy solid lines and marked RR-6 on Schedule ' A' to this By-law, which schedule is attached to and forms part of this By-law. - 2 - 3. THIS By-law comes into force: a) where no notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto, upon the expiration of the prescribed time; or b) where notice of objection has been filed with the Township' s Clerk within the time prescribed by the Planning Act 1983 and regulations pursuant thereto , upon the approval of the Ontario Municipal Board . READ a THIRD time and FINALLY PASSED this 16th day of March, 1989 . � --� � REEVE CLERK FORM 1 PLANNING ACT, 1983 NOTICE OF THE PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE TOWNSHIP OF BAYHAM TAKE NOTICE that the Council of the Corporation of the Township of Bayham passed By-Law No . Z184-89 on the 16th day of March, 1989 under Section 34 of THE PLANNING ACT, 1983 . AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-Law by filing with the Clerk of the Township of Bayham not later than the 20th day of April , 1989 , a notice of appeal setting out the objection to the By-Law and the reasons in support of the objection. An explanation of the purpose and effect of the By-Law, describing the lands to which the By-Law applies, and a key map showing the location of the lands to which the By-Law applies (or , alternatively an explanation as to why a key map is not provided) are attached . PETRIE CLERK OF THE TOWNSHIP OF BAYHAM BOX 160 STRAFFORD'VILLE, ONTARIO NOJ 1Y0 EXPLANATORY NOTE The purpose of By-law No. Z184-89 is to change the zoning on a 0. 35 hectare (0.86 acre) parcel of land situated on the north side of County Road No . 44 , in Part of Lot 21 , Concession 9, in the Township of Bayham, from the Agricultural (Al) Zone to the Special Rural Residential (RR-6) Zone. The effect of this By-law will be to recognize the creation of a rural residential lot as a result of a surplus farm dwelling pursuant to the process of severance and conveyance. The Special Rural Residential (RR-6) Zone is required in order to recognize two existing greenhouses on the subject lands as being permitted accessory structures. Additionally, the Special Rural Residential (RR-6) Zone recognizes the location of these structures in relationship to the main building. This by-law is intended to implement the policies of Official Plan Amendment No . 39 which designates the subject lands as "Rural Residential .
